ApriI 27, 1982 "AN ORDINANCE TO AMEND CHAPTER 20 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973i BY AMENDING SECTION 20-56 THEREOF PERTAINING TO BUSINESS LICENSES FOR COMMISSION MERCHANTS AND BY ADDING THERETO SECTION 20-74 PERTAINING TO SAVINGS AND LOAN ASSOCIATIONS." 82-147 "Consideration of an ordinance to amend Section 2-303 of the City Code pertainin to the Museum and Fine Arts Commission. The Museum and Fine Arts Commission has requested a change to the City Code to assist in their fund raising efforts. The City Attorney and the Director of Finance have reviewed the Commission's request and indicated the proposed wording change would not have a negative impact on the City. The City Manager recommends adoption.' On motion of Mr. Barnes and seconded by Mr. Gray, the following ordinance was adopted on first and final reading, and by the following vote: "AN ORDINANCE TO AMEND SECTION 2-30 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO THE MUSEUM AND FINE ARTS COMMISSION." Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen Nays: None 82-148 "Consideration of an ordinance to amend Section 24-151 of the City Code pertaini to fees for City swimming pools. At its March meeting, the Parks and Recreation Commission approved a new fee schedule for City operated swimming pools. This ordinance will increase the fee from 35¢ for everyone to 50~ for children under 12 and 65~ for 13 and up for 1982. The City Manager recommends adoption. On mation of Mr. Barnes and seconded by Mrs. Webb, the following ordinance was adopted on first and final reading, and by the following vote: "AN ORDINANCE ro AMEND SECTION 24r151 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO FEES FOR CITY SWIMMING POOLS." Ayes: Barnes, Gray, Oast, Webb, Whitlow, Johansen Nays: Beamer 82-149 "Consideration of a motion to appoint the firm of Frederick B. Hill and Company as the City's independent auditor for the 1982 annual audit. The Municipal Finance Commission and Company as the City's independent letter is attached. The City Manager has recommended the appointment of Frederick B. HilI auditor for the annual audit for 1982. A copy of their recommends adoption." Motion of Mr. Whitlow and seconded by Mr. Beamer, that the matter be deferred, and was adopted by unanimous vote. 82-150 "Consideration of a motion to receive as information the Quarterly FinanciaI Report for the period ended March 31, 1982. This quarterly financial report is submitted in accordance with the City Code, Section i1-43 (a) ($)." Motion of Mr. Barnes and seconded by Mrs. Webb, the report ro be received as information and was adopted by unanimous vote. 82-151 "Consideration of a resolution authorizing the City Manager to release a utilit easement on Queen Street. On August 8, 1967, City Council adopted an ordinance closing a portion of Queen Street lying between the eastern right-of-way line of Route 58 and the western right-of-way line of Douglas Avenue. The ordinance also retained an easement for the City to maintain and operate public utility lines within the area of the closed street. The Public Utility Depart ment advises that these lines have now been relocated. PRHA has requested that the easement be released so that this parcel of property, which is now owned by PRNA, can be used as a development parcel with other properties in the area. This property ~s located in the Mt. Her mort Conservation and Redevelopment Project and will be a portion of the site for the Portsmou Orthopedic Center to be constructed. The City Manager recommends adoption." On motion o£ Mrs. Webb and seconded by Mr. Beamer, the following resolution was adopted, a~d by the following vote: "A RESOLUTION RELEASING A UTILITY EASEMENT IN A PORTION OF QUEEN STREET (CLOSED). WHEREAS, by Ordinance adopted by the Council of the City of Portsmouth, Virginia, on August 8, 1967, a portion of Queen Street lying between the Eastern right-of-way line of Route 58 and the Western right-of-way line of Douglas Avenue was closed and vacated as public street; and WHEREAS, by said Ordinance the City of Portsmouth reserved a and privilege to maintain, operate and replace all public utility area so closed and vacated; and perpetual right, easement lines now situate within the .g
