April 27, 1982 <br /> <br /> WHEREAS, the utility lines located in the area of Queen Street which was closed by the <br />aforesaid Ordinance have been relocated by the Public Utility Department; and <br /> <br /> WHEREAS, the City of Portsmouth no longer requmres the use of said easement and the same <br />is hereby declared to be excess property of the City; and <br /> <br /> WHEREAS, said portion of Queen Street which was closed by the <br />located in the Mount Hermon Conservation and Redevelopment Project <br />velopment and Housing Authority has requested that the easement be <br />make the property available for development; and <br /> <br />aforesaid Ordinance is <br />and the Portsmouth Rede- <br />released in order to <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority owns the underlying fee <br />on the property occupied by said easement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the easement reserved by the City of Portsmouth to maintain, operate and renlace public <br />utility lines within the area of Queen Street lying between the eastern right-of-way line <br />of Route 58 and the western right-of-way line of Douglas Avenue be, and the same hereby is, <br />released and vacated as a perpetual easement, right and privilege of the City of Portsmouth. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby <br />a deed of release relinquishing all rights, privileges and easements <br />in said property." <br /> <br />is, authorized to execute <br />which the City reserved <br /> <br />Ayes: Barnes, Beamer, Gray, Oast, Webb, Whitlow, Johansen <br />Nays: None <br /> <br />82-152 "Consideration of a motion to refund real estate taxes that were paid in error. <br /> <br /> this motion will authorize the refund of $401.76 inertial estate taxes <br />to Bessie Bullock which were paid and assessed in error for the 1980-81 and 1981-82 tax years <br />The City Manager recommends adoption." <br /> <br /> Motion of Mr. Beamer and seconded by Mr. Barnes, that authorization be granted to refund <br />Bessie Bullock $401.76, with interest, on real estate taxes paid in error, and was adopted by <br />unanimous vote. <br /> <br /> 82-153 - "Report of transfer of funds from the Emergency Budget Contingency in the amount <br />of $85,000 for Worker's Compensation claims and benefits. <br /> <br /> This transfer is reported in conformance with the City Code. The budget allowance for <br />FY 1982 for Worker's Compensation has been depleted. This transfer is necessary in order to <br />fund benefits authorized by the Industrial Commission for work related injuries as well as <br />disability retirement benefits to qualified employees under the Heart/Lung Bill." <br /> <br /> Motion of Mr. Whitlow and seconded by Mr. Gray, the report to be received as information <br />and was adopted by unanimous vote. <br /> <br /> 82-154 - "The City has advertised and received, bids to construct left turn lanes at <br />the intersection of Frederick Boulevard and Scott Street and at the intersection of High <br />and Hartford Streets. These improvements are listed in the 1981-86 tIP. The low bid for <br />these improvements was received from Aldo Construction for $26,023.80. The total cost to <br />the City for these improvements will be $35,400.00 and sufficient monies have been trans- <br />ferred to cover all costs. The City Manager recommends award of a Construction contract <br />to the low bidder. <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Gray, that the contract be awarded to Aldo <br />Construction, being the lowest responsible bidder~ and was adopted by unanimous vote. <br /> <br />On motion meeting adjourned. <br /> <br /> <br />
