<br /> Town and Country Associates, Ltd., has made application to vacate and close a portion of
<br />Wal'd~on Avenue. -~i~lef~'~were appointed by resolution on July 13, 1982 pursuant to State law.
<br />A copy of the Viewers~ report and a map showing the portion of Waldron Avenue to b~e closed are
<br />attached to the ordinance. The viewers, Planning Commission and City Manager recommend closing
<br />of that portion of Waldron Avenue."

<br /> James Maddox, Jr., 2116 Greewood Drive, spoke in opposition to closing a portion of Waldron
<br />Avenue. He claimed he was not. ce~ta~t~viewers but he did not object to all of Waldron Avenue
<br />being closed. .,:

<br /> On motion of Mr. Gray and seconded by Mr. Beamer to refer matter back to the viewers for
<br />a full report was adopted by unanimous vote.

<br /> 82-293 "Consideration of a resolution authorizing the City Manager to grant ~ utility
<br />easement to th~pni&_e~.States Navy for installation of sanitary sewer lines on a portion of
<br />Elm Avenue.
<br />
<br /> The Nave.1 Faci.lities Engineering Command has requested an easement agreement along and
<br />across the right-of-way of Elm Avenue in the vicinity o£ Atlantic Creosoting Company. The
<br />easement is necessitated for construction of new sanitary sewage facilities which are being
<br />installed at the Naval Shipyard. The Engineering Department and the Public Utilities Departmen~
<br />have reviewed t~e oon~ruction plans and have approved same. This resolution will authorize
<br />the City Mana~ar..to. sign the easement agreement. The City Manager recommends adoption.

<br /> On motion of Mrs. Webb and seconded by Mr. Whitlow the following resolution was adopted
<br />and by the following vote:

<br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT A
<br />UNITED STATES OF AMERICA, DEPARTMENT OF THE NAVY, FOR
<br />SEWER LINES ON A PORTION OF ELM AVENUE.

<br />UTILITY EASEMENT TO THE
<br />INSTALLATION OF SANITARY
<br />
<br /> WHEREAS, the United States of America, Department of t~e Navy, has made application
<br />installation of sanitary sewer lines along a portion of Elm Avenue to serve the Norfolk
<br />Naval Shipyard in Portsmouth; and
<br />
<br />for
<br />
<br /> WHEREAS, said plans for installation of tho utilities have been approved by the Public
<br />Utilities Department and the Department of Engineering and Technical Services of the City of
<br />Portsmouth; and
<br />
<br /> WHEREAS, the installation of said sewer facilities required an easement on property owned
<br />by the City of Portsmouth in the ~icinity of Elm Avenue and the property now or formerly owned
<br />by the Atlantic Creosoting Company.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the
<br />City Manager be, and he hereby is, authorized to sign an easement agreement between the City
<br />of Portsmouth, Virginia and the United States of America, Department of the Navy, for installatisn
<br />o£ sanitary sewer lines along, across and under a port,on of Elm Avenue; said easement being I
<br />more particularly described by reference to Exhibit A and Exhibit B attached hereto

<br />
<br /> Bids were received pursuant to the advertised sale of City-owneJ property located in the
<br />City of Chesapeake. The highest bid received was that of John W. Johnson in the amount of
<br />$5,4000 This resolution authorizes the:~ity Manager to convey the property., The appraised
<br />value of the property is approximately $5,000. The City Manager recommends adoption.

<br /> On motion of Mrs. Webb and seconded by Mr. Gray the following resolution was adopted and
<br />by the following ~ote:

<br />"A RESOLUTION ACCEPTING THE BID OF JOHN W. JOHNSON TO PURCHASE CERTAIN PROPERTY LOCATED IN
<br />THE DEEP CREEK BOROUGH IN THE CITY OF CHESAPEAKE; AUTHORIZING THE CITY MANAGER TO CONVEY.
<br />
<br /> WHEREAS, the Council of the City of Portsmouth
<br />certain hereinafter-described property owned by the
<br />Chesapeake, VirgiD~a; and
<br />
<br />has requested offers for the purchase of
<br />City of Portsmouth located in the City of
<br />
<br /> WHEREAS, the highest offer to purchase said prcperty was made by John W. Johnson in the
<br />amount of Five Thousand, Four Hundred Dollars ($5,400.]; and
<br />
<br /> WHEREAS, said property is no longer needed by the City of Portsmouth and is hereby declar,
<br />to be excess property; and
<br />
<br /> WHEREAS, it is the opinion of this Council that it is in the best interest of the City to
<br />dispose of said property by sale to John W. Johnson.
