152 <br /> <br />August 24, 1982 <br /> <br /> Mr. Barnes stated that during the public comment period we did not receive any Co~ep-ts <br />from Mr. Wallace or Mr. Hartley. We did, however, receive input from individuals and civic <br />groups which lead to the changes being made this evening. Further, he stated that Rules of <br />Procedure are necessary for an orderly meeting and a time limit is essential. <br /> On motion of Mr. Barnes and seconded by Mrs. Webb the following ordinance was adopted <br /> and by the following vote: <br /> <br /> Motion of Mr. Holley and seconded by Mr. Beamer to amend the ordinance by deleteing <br /> allocation of time limit. Amendment to ordinance was defeated by a vote of 5-2 (Beamer-Holley <br /> "AN ORDINANCE TO hMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING <br /> SECTIONS 2-17, 2-49 and 2-56 THEREFORE, PERTAINING TO CITY COUNCIL." <br /> <br /> Ayes: Barnes, Gray, Webb, Whitlow, Johansen <br /> Nays: Beamer, Holley <br /> <br /> 82-319 "Consideration of a motion to amend the Council's Rules of Procedure. <br /> This motion amends the Council's Rules of Procedure in accordance with the Committee's <br />recommendations." <br /> <br /> Motion of Mr. Barnes and seconded by Mrs. Webb the motion was adopted by a vote of <br />6-1 (Holley). <br /> <br /> 82-320 - "Consideration of an ordinance amending the City Code pertaining to the sale of <br />unclaimed personal property. <br /> <br /> This ordinance will bring the City Code into compliance with the State Code. A major <br />change is the requirement that before unclaimed proFerty can be sold, the State Treasurer must <br />be given the right to accept said property on behalf of the State. The City Manager recommend <br />adoption." <br /> <br /> On motion of Mr. Whitlow and seconded by Mr. Gray the following ordinance was adopted and <br />by the following vote: <br /> <br /> "AN CRDINANCE TO ~34END CHAPTER 29 OF THE CODE OF THE CITY OF PORTSMOUTH, PERTAINING TO <br /> UNCLAIMED PROPERTY IN CUSTODY OF POLICE." <br /> <br /> Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br /> Nays: None <br /> <br /> 82-321 "Consideration of a resolution opposing the proposed limitation by the General <br />Assembly of Virginia on local governments in assessing restaurant food tax and transient <br />occupancy tax. <br /> <br /> This resolution cites the importance of the restaurant food tax and lodging tax to <br />Portsmouth, which anticipates receiving $1,725,000 from the two sources in the current <br />fiscal year. Their elimination or rollback would require the City to increase to an <br />unacceptable degree its reliance on the local real estate property tax. The City Manager <br />recommends adoption." <br /> <br /> Mr. Barnes and Mr. Beamer stated its very important we pass ~this resolution and return it <br /> to Richmond as soon as possible. <br /> <br /> Mr. Whitlow requested the resolution be sent to our Citizen's Committee. <br /> Motion of Mr. Whitlow and seconded by Mr. Barnes the following resolution was adopted and <br />by the following vote: <br /> <br /> "A RESOLUTION OPPOSING THE PROPOSED LIMITATION BY THE GENERAL ASSEMBLY OF VIRGINIA <br /> ON LOCAL GOVERNMENTS IN ASSESSING RESTAURANT FOOD TAX AND TRANSIENT OCCUPANCY TAX. <br /> WHEREAS, the Joint Subcommittee of the General Assembly of Virginia is studying a <br /> proposal to place limitations on local governments in assessing restaurant food tax (meals <br /> tax) and transient occupancy tax (lodging tax); and <br /> <br /> WHEREAS, such taxes as presently authorized constitute a major source of revenue for <br /> local governments; and <br /> WHEREAS, such taxes are estimated to produce $1,725.C00. in revenue for the City of <br /> Portsmouth in the year 1982-83; and <br /> <br /> WHEREAS, the City of Portsmouth has continuously sought authorization to establish <br /> alternate sources of revenue insuring a more equitable idsbursement of the burden of funding <br /> local government; and <br /> WHEREAS, the result of this proposed limitation would place an increased burden for the <br /> funding of local government operations on the local real estate property owner. <br /> NOW, THEREFORE, BE I~ RESOLVED by the Council of the City of Portsmouth that the Council <br /> does hereby express its opposition to the proposed limitation on local governments in <br /> assessing restaurant food tax and transient occupancy tax unless alternate sources of <br /> revenue are provided. <br /> <br /> <br />
