%49 <br /> <br />August 2g, 1982 <br /> <br />Other Items Under Unfinished Business <br /> <br />82-120 Rezoning applications and a group housing project: <br /> <br /> (f) GHP-82-1 Resolutian gr~nti~g approva~:~,fo~-a2Group Mousing Prbj-ect pursuant to <br />ection 4--55 of the Code of the City of Portsmohth/ Virginia, 1973, as amended, said project <br />eing known as "Crawford Bay at Olde Towne" and designated as GHP-82-1, deferred from meeting <br />f May 11, 1982. <br /> <br /> Danny K. Smith, Attorney for Olde Towne Land Trust asked for approval of project and for <br />Historical Zoning. Mayor Johansen asked when building would start. Mr Smith replied as soon <br />as building permits obtained. Mrs. Webb asked if bonded pile driving would be used. Mr. Smith <br />responded only bonded contractors would be used. <br /> <br /> On motion of Mr. Holley and seconded by Mr. Gray to following resolution was adopted and <br />by the following vote: <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-58 <br />~F TH~ EO~E OE THE E~y O~ ~R~§M~UT~, V~R~:INI~, 1973, AS A~{ENDED, SAID PROJECT BEING <br />KNOWN AS "CRAWFORD BAY AT OLDE TOWNE" AND DESIGNATED AS GHP-82-1." <br /> <br /> WHEREAS, Olde Towne Trust has mad~ application pursuant to Section 40-85 of the Code of the <br />City of Portsmouth, Viriginia, 1973, as amended, for the granting and approval of a grou½ <br />housing project known as "Crawford Bay At Olde Towne"; and <br /> <br /> ~HEREAS, the application has been determined by the Planning Commission to have met <br />requirements of ~40-55, Code of the City of Portsmouth, Virginia 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith and has recommended approval of said application; and <br /> <br /> WHEREAS, the developer ~as been informed that approval of the group housing project pursuant <br />to said Section 40-55 grants only an exemption from certain requirements for residences as <br />stated in said section &~n~ does not constitute a waiver of any other requirement embodied in <br />the Subdivision Ordinance, Zoning Ordinance, the Code of the City of Portsmouth, or any other <br />applicable local, state or federal laws or regulations; and <br /> <br /> WHEREAS, the developers are aware that building permits or any other required permit will <br />be issued only upon compliance with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFOR£, BE <br />certain group housing <br />and more specifically <br />dated August 17, 1982, <br />officials of the City <br /> <br />IT RSSOLVED by the Council of the City of Portsmouth, Virginia, that the <br />project known as "Crawford Bey at Olde Townet' and designated as GHP-82-1, <br />shown on plans prepared by Yates and Berkeley Associates, Ltd., Architects, <br /> and designated as a revised proposal and filed with the appropriate <br />of Portsmouth and made a part hereof, is hereby granted approval. <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> (i) Z-82-10 Petition of Olde Towne Land Trust to rezone property on the southside of <br />Crawford Par~y near the Crawford One Condominium from Waterfront W-1-K (conditional) to <br />Residential R-60-A. The City Attorney advises that the parcel automatically reverted to R-60-A <br />on July 1, 1982 and that a motion to remove from the agenda ~s appropriate. <br /> <br /> Motion by Mr. Gray and seconded by Mr. Beamer to remove (i) Z-82-10 from the agenda was <br />approved by unanimous vote. <br /> <br />82-~$5 (a) Z~82-17 Petition of William E. Manning, by Gary E. Frye, Agent, to rezone <br /> ~ ~ property at 450~ ~o~ts~ou~-~B~.uleYard from ~ffice Residential OR-TS <br /> to Commercial C-1. <br /> <br /> Gary E. Frye, Agent spoke in favor of the petition and answered Council questions on plans <br />for property. <br /> <br /> motion of Mr. ~Beamer and seconded by Mr. Holley the following ordinance-approved~on first <br />r~ading was taken up and read and adopted by the following vote: <br /> <br />"ZONING ORDINANCE ~MENDMENT Z-82-17" <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> The following reports from the City Manager were presented: <br /> <br /> 82-311 "Consideration of an ordinance on first reading to appropriate $30,000 from the <br />Capital Improvements Fund for the construction of cart paths at the Portsmouth Golf Course. <br /> <br /> <br />
