163 <br /> <br />September 28, 1982 <br /> <br /> 82-349 "Consideration of an ordinance to appropriate $40,000 from the Capital Improvement <br />Fund for engineering services and contingencies for the preparation of a preliminary application <br />for a waiver for secondary treatment requirements at the Pinners Point Sewage Treatment Plant. <br /> <br /> This appropriation would provide funds for engineering services and contingencies for the <br />preparation of a preliminary application to EPA for a waiver for secondary treatment requirements <br />at the Pinners Point Plant. The preliminary application must be submitted to EPA on or before <br />December 29, 1982. If the preliminary application is accepted, and extensive monitoring <br />and sampling program would have to be instituted to provide the necessary technical information <br />required to support our application. If the application is made and our attempt to delay the <br />improvements of secondary treatment at our Pinners Point Plant to coincide with similar <br />construction at the Lambert's Point Plant is successful, the City will save literally millions <br />of dollars. ' <br /> <br />82-550 'Jgenaideration_9~ An ordinance ,Qloaing a portion ,of. commerce Street <br /> <br /> The Portsmouth Industrial Development Authority has made application to vacate and close a <br />portion of Commerce Street. Viewers were appointed by Council Resolution on August 24, 1982. <br />A copy of the viewers report and a map showing the portion to be closed are attached for your <br />information. Yhe City Manager recommends adoption." <br /> <br /> Motion of Mr. Beamer and seconded by Mr. Gray %o adopt ~he~ recommended-ordihance, ~tosigg <br />a p~r~{~n-of commerce Street. <br /> <br /> Mr. Lieberman announced that the Portsmouth Industrial Development Authority had asked for <br />the matter to be deferred. The City Manager asked for a 30 day deferrment. <br /> <br /> Substite motion by Mr. Whitlow and seconded by Mrs. Webb the ordinance closing a portion of <br />Commerce Street was deferred for 30 days, was adopted by unanimous vote. <br /> <br /> 82-351 "Consideration of a resolution authorizing the City Manager to convey an easement <br />on City owned property to the City of Suffolk (Alabama Avenue at Hollywood Avenue). <br /> <br /> The City of Suffolk has requested Portsmouth to grant an easement on property located at the <br />intersection of Alabama Avenue and Hollywood Avenue in Suffolk. This easement will permit the <br />City of Suffolk to construct certain street improvements to Alabama Avenue. The Director of <br />Public Utilities has reviewed this matter and has no objection to the granting of said easement. <br />The City Manager recommends adoption." <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Whitlow the following resolution was adopted and <br />by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY ~NAGER TO CONVEY AN EASEMENT ON CITY OWNED <br />PROPERTY TO THE CITY OF SUFFOLK, VIRGINIA (ALABAMA AVENUE AT HOLLYWOOD AVENUE). <br /> <br /> WHEREAS, the City of Portsmouth owns certain real property located in the City of <br />Suffolk acquired from the Berkley and Suffolk Water Company, said property being located Rt <br />the intersection of Alabama Avenue and Hollywood Avenue; and <br /> <br /> WHEREAS, the City of Suffolk desires to acquire an easement on the hereinafter-described <br />portion of said property for the purpose of street improvements to Alabama Avenue; and <br /> <br /> WHEREAS, the City of Suffolk has agreed to make such street repairs in a manner so as <br />not to interfere with or damage the City of Portsmouth water transmission line and has also <br />agreed that the City of Portsmouth shall no~ be responsible for any costs related to the street <br />· mprovement or the maintenance of the water transmission line; and <br /> <br /> WHEREAS, Section 2.09 (c) of the Charter of the City of Portsmouth provides that <br />interest in regl property may be conveyed to the Commonwealth of Virginia or a political sub- <br />division thereof without advertisemen~ or receipt of bids; and <br /> <br /> WHEREAS, the City of Suffolk is a municipal corporation of the Commonwealth of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is, authorized to convey an easement on the hereinafter- <br />described real property located at the intersection of Alabama Avenue and Hollywood Avenue to <br />the City of Suffolk, said property being more particularly described as follows, to-wit: <br /> <br /> Beginning at a point on the norther~ boundary of Alabama Avenue in the center of the <br /> northern edge of its intersection with Hollywood Avenue and running from said beginning <br /> point northwardly 4.6 feet to a point, a corner; thence running in an easterly direction <br /> a line which is 4.6 feet north of the boundary line of Alabama Avenue 246.8 feet to a <br /> point distant 30 feet from the northeast corner of Lot 9; thence continuing in a straight <br /> line 35.3 feet to the point of inter~ectmon with the northern boundary of Alabama Avenue, <br /> a corner; thence running westwardly ~long the present boundary of Alabama Avenue to,the <br /> point of beginning, and being more p~rticularly shown on a sketch therof, entitled City of <br /> Suffolk, Part Plat - Alabama Ave., Cypress Borough, Hollywood Subdivision" hereto attached <br /> and made a part hereof, reference thereto being hereby specifically made. <br /> <br /> <br />
