<br />special tax and specifically state that additional governmental services and facilities per-

<br /> Motion of Mrs. Wehb and seconded by Mr. Gray the £ollowing resolution was adopted, and
<br />by the following vote:

<br /> "A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO AMEND THE CHARTE~_ O
<br /> THE CITY OF PORTSMOUTH, VIRGINIA. F

<br /> WHEREAS, Section 15.1-835 of the Code of Virginia, 1950, as amended, provides for the
<br /> amendment of th~ City Charter upen the holding of a public hearing to determine if the
<br /> citizens of the City desire that the amendment to the City Charter be granted, and by forwardi
<br /> thereafter a request to one (1) or more of the members of the General Assembly representing
<br /> the City to introduce the proposed change as a bill in the succeeding session of the eneral
<br /> Assembly; and
<br />
<br /> WHEREAS, the City Council is of the opinion that certain amendments to the Chart r of
<br /> the City of Portsmouth.is necessary and desireable at this time and has, on this date held
<br /> such public hearing required by law to consider such amendments.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council C£~ the City of Portsmouth, Virgini~ , that
<br />the City Attorney is hereby directed to prepare and transmit to the members of General
<br />Assembly representing the City, to§ether with certified copies of this resolution, a raft
<br />of a bill amending the Charter of the City of Portsmouth, 1970, as follows:

<br /> 1. By amending A~ticle II, §2.02:1 to read as £ollows:
<br />
<br />Section 2.02:1. Special Service District.
<br />
<br /> A special service district of the downtown business district of the City of Port nouth
<br />shall be created by the governing body of the City of Portsmouth, upon petition of fifty-one
<br />(51) percent of the ta×paying preperty owners of the proposed district. Upon the filing of
<br />such petition, the governing body shall fix a date for a public hearing on the questio~ of the
<br />proposed service district, which hearing shall embrace a consideration of whether the property
<br />within the proposed district will be ~enefited by the ~stablishment thereof. Notice oC such
<br />hearing shall be given by publication once a week for three consecutive weeks in a new~paper
<br />of general circulation ~n the City of Portsmouth, and the hearing shall not be held so~ner
<br />than ten days after completion of such p~'hlication.

<br /> After creating the special service district, the City Council shall have the following
<br />powers and duties with respect to the servmce district:
<br />
<br /> 1. To construct, maintain, and oerpate such facilities and equipment as may be n~cessary
<br />or desirable to provide additional governmental services and/or facilities including ]blic
<br />transportation services, parking facilities, promotion of the business district, and ~Ldewalks
<br />and pedestrian malls for the use and benefit of the public in such service district.

<br /> 2. To acquire, ~t~iL~ and ~er~ any such facilities and equipment an may be ·
<br />and desirable to provide such additional governmental services in such district, and t.
<br />acquire rights, title, interest or easements therefor in and to real estate in such se
<br />district.

<br /> 3. To contract with any person, firm, corporation, or political subdivision to p~
<br />such additional governmental services or facilities in such district and to construct,
<br />establish, maintain, and ~e~%~ any such facilities
<br />desirable in connection therewith.

<br /> 4. To levy and collect an annual tax upon any property in such service district
<br />to local taxation to pay, either in whole or in part, the expenses and charges for pro~

<br />maintaining, and operating such facilities and equipment as may be necessary and desir~
<br />connection therewith, provided that the proceeds from such annual tax shall be so segr~
<br />as to enable the same to be expended in the district from which collected.
