<br /> The Director of Public Works recommends acceptance of the Iow bid; therefore, the
<br />appropriation will be for the low bid price of $6,883 plus 10% for contingencies or a total
<br />of $7,600. I recommend adoption of the attached ordinance on first reading."

<br /> On Motion of Mr. Graf ~ndcseconded by Mrs. Webb, the following ordinance was approved on
<br />first reading, and by unanimous vote:

<br /> "AN ORDINANCE TO APPROPRIATE $7,600 FROM THE CAPITAL IMPROVEMENT FUND FOR INSTALLATION
<br /> OF A SECURITY FENCE AT THE ELECTRICAL AND RADIO SHOP."

<br /> 82-425 "Letter from the City M~nager recommending the adoption of an ordinance to amend
<br />the City Code by adding to Chapter 11 thereof, Article V, pertaining to public procurement~
<br />and, repealing Sections 11-12 and 11-18"
<br />
<br /> "In its last session, the General Assembly adopted the State Procurement Act which outlin~
<br />new procedures for not only state procurement, but the procurement procedures of all political
<br />subdivisions within the state.
<br />
<br /> On or after January 1, 1983, all contracts and purchases will be subject to this new
<br />statute which is designed to foster public Confidence in our purchasing system, as well as to
<br />stimulate competition. Through these new procedures the City will be able to fairly and
<br />equitability administer the purchase of goods and services, thereby providing the best quality
<br />of goods at the lowest possible cost to the taxpayers.
<br />
<br /> The attached ordinance I have placed on your agenda for the December 14, 1982 Council
<br />meeting will fully bring the City into compliance with the state law. In addition, I have
<br />included a copy of the internal financial directive with which alt City departments will be
<br />required to comply. The directive is tailored to our system and while in all cases it complies
<br />with the law, it is more restrictive in some areas. I recommend adoption of the ordinance.

<br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following ordinance was adopted and

<br /> "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY ADDING TO
<br /> CHAPTER 11 THEREOF, ARTICLE V, PERTAINING TO PUBLIC PROCUREMENT, REPEALING SECTIONS 11-12
<br /> AND 11-18."

<br /> Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen
<br /> Nays: None
<br />
<br /> 82-426 - "Letter from the City Manager recon~ending the adoption of an ordinancn~to amend
<br /> the City Code by adopting Section 23-483 pertaining to certain motor vehicle license fees."
<br />
<br /> "As you may be aware, the Soldiers and Sailors Civil Relief Act exempts non resident
<br /> military personnel from paying tangible personal property tax to the locality where they are
<br /> stationed. This exempts from Portsmouth personal property tax vehicles which are with
<br /> military personnel who are stationed here on orders.
<br />
<br /> However, many military personnel residing in Portsmouth do not purchase a City decal,even
<br /> if their vehicles are registered in Virginia. Apparently, legal officers on military baseg
<br /> advise personnel that ~e~ are not required. When a Portsmouth Police Officer sees a
<br /> vehicle which is registered in Virginia whithout a decal, he or she will ticket the vehicle as
<br /> being in violation of City Code (not knowing if military or not).
<br />
<br /> I recommend that you adopt the attached ordinance, which would require non resident
<br /> military personnel~who are living in Portsmouth, and whose vehicles are registered in Virginia,
<br /> to obtain a decal for identification purposes. The annual fee would be $10,00 considerably les:
<br /> than the $20-$25 fee charged for vehicles owned by non military personnel. The decal will
<br /> facilitate Police enforcement, reduce wasted and unnecessary time in court and is essential to
<br /> the functioning of the City's licensing and registration requirements. The ordinance will also
<br /> clarify requirements for military personnel and make it easier for them to comply with the law.
<br />
<br /> The City Attorney, Chief of Pol~e and Commissioner of the Revenue all support adoption
<br /> of this ordinance, which is similar to requirements in Virginia Beach and Chesapeake."

<br /> On motion of Mr. Gray and seconded by Mr. Whitlow to refer the item back to the City Manager
<br /> for further study was adopted by unanimous vote.
<br />
<br /> Mr. Whitlow asked that the different Commands in our City be consulted for their input to
<br /> the proposall.
<br />
<br /> 82-427 - "Letter from the City Manager recommending the adoption of a resolution requ~stin
<br /> the General Assembly of Virginia to amend the Charter of the City of Portsmouth."
<br />
<br /> "In accordance with the applicable law, a Public Hearing has been scheduled as part of
<br /> your December 14, 1982 meeting to determine if the citizens of the City desire an amendment to
<br /> the City Charter and the attached resolution requests the General Assembly of Virginia to amend
<br /> the Charter regarding the Special Service Tax District.
<br />
<br /> If you will recall, this section of the Charter was adopted by the 1982 General Assembly
<br /> and requires a petition of 95% of the ~axpaying property owners of the proposed district in
<br /> order to create Downtown Tax District. The proposed amendment would grant such authority to
<br /> the Council upon receipt of a Petition of 51% of the ~axpaying property owners of the proposed
<br /> district.
