229 <br /> <br />January 11, 1983 <br /> <br /> 83-8 - "Letter from the City Manager recommending adoption of an ordinance to amend the <br />City Code pertaining to penalties for violations of various traffic ordinances." <br /> <br /> "The amendments which are proposed to Sections 23-105(c), 23-106(c), 23-308, 23-309(b) <br />and 23-391(e) of the City Code deal solely with the penalties imposed for violations of <br />these traffic ordinances. These minor procedural changes are necessary in order that the City <br />Code remain consistent with the provisions of the State Code, and to insure that appropriate <br />penalties are imposed for violations of these ordinances." <br /> <br /> On motion of Mr. Whitlow and seconded by Mr. Beamer, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING <br />SECTIONS 23-105(c), 23-106(c). 23-308, 23~309(b), 23-311, and 23-392(e) THEREOF, PERTAIN- <br />ING TO PENALTIES FOR VIOLATIONS OF VARIOUS TRAFFIC ORDINANCES." <br /> <br />Ayes: Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 83-9 "Letter from the City Manager recommending adoption of a motion authorizing the <br />refund of 1615.56 to L & R Realty Corporation, for the overpayment of real estate taxes." <br /> <br /> "It has recently been brought to our attention that real estate taxes have been erroneously <br />assessed and paid on property owned by L & R Realty Corporation, formally owned by Star Band <br />Realty Corporation, located in an area bounded by Portland Street, Mr. Vernon Avenue, Commerce <br />Street and Broad Street. This occurred when th~ same property was inadvertently assessed <br />under both names as the result Of considerable ~onfusion created by the various sales transactio <br />involved with the properties. For fiscal year 1981-82 the taxes were paid for the 1st quarter <br />by both parties. <br /> <br /> The City Assessor certifies that an overpayment was made and indicates that a refund of <br />$615.56, without interest, is in order. I recommend the adoption of a motion authorizing such <br />refund." <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Whitlow, that authorization be granted to refund <br />$615.56 to L & R Realty Corporation, as requested, and was adopted by unanimous vote. <br /> <br /> 83-10 "Letter from the City Manager recommending adoption of a motion authorizing the <br />refund of $35.60 for personal property taxes paid in error. <br /> <br /> "The Commissioner of Revenue is requesting a refund of $35.60 in Tangible Personal Property <br />Taxes for Russell Edwards, 4708 Mallard Crescent, Portsmouth, Virginia 23703. <br /> <br /> Mr. Edwards was taxed in error on his 1968 boat for the year 1982. His boat was berthed in <br />Norfolk asf~J&nuary 1, 1982 and he paid taxes there." <br /> <br /> Motion of Mr. Beamer and sezonded by Mr. Whitlow, that authorization be granted to refund <br />$35.60 to Russell Edwards, as requested, and was adopted by unanimous vote. <br /> <br /> 83-11 "Letter from the City Manager recommending adoption of a motion authorizing the <br />refund of $134 for personal property taxes paid in error." <br /> <br /> "The Commissioner of Revenue is requesting a refund of $134 in Tangible Personal Property <br />Taxes for Ms. Gw~ndolyn N. Adam~, 960 Lake Village Drive, Apt. H. Chesapeake, VA 23323. <br /> <br /> Ms. Adams was taxed in error on her 1978 Chevrolet Monte Carlo for the year 1982. She <br />Was living in'Chesapeake as of January 1, 1982, and paid taxes For the year 1982 on November 4, <br />1982 to the City of Chesapeakei" <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Beamer, that authorization be granted to refund <br />-~134 to Ms. Gwendolyn H. Adams, as requested, and was adopted by unanimous vote. <br /> <br /> 83-12 ~' "Letter from the City Manager recommending adoption of a motion to transfer from <br /> the Emergency. Budget Contingency Account $67,993.45 to cover the payment of a court-ordered <br /> judgement." <br /> <br /> "The Supreme Court of Virginia has recently denied the City of Portsmouth's petition to <br />appeal a jury verdict holding the City liable to Hanover Apartments for damages sustained as <br />the result of f~o6ds that occurred in 1974 and 1975, with interest from the date of the storm. <br />The City Attorney has reviewed the Supreme Court's decision and recommends that no further <br />appeal be taken. <br /> <br /> In order to pay the judgement, I <br />Budget Contingency Account." <br /> <br /> Motion or'Mrs. Webb and seconded <br />$67,993.45 from the Emergency Budget <br />unanimous vote. <br /> <br />recommend the transfer of $67,993.45 from the Emergency <br /> <br />by Mr. Whitlow, that authorization be granted to transfer <br />Contingency Account, as requested, and was adopted by <br /> <br /> <br />
