January ll, 1983 C'o'nse~,~ge~da 82-418 Rezoning and Use Permit Applications: On~Bo~ion of Mr~ Gray and seconded by Mrs. Webb, the following Items (d), (i), (j), (k), (1), approved On first reading at the Public Hearing of ~ecember 15, 1982; and Item 82-424, approved on first reading at the regular meeting of December 14, 1982, were adopted and by the following-~vOte,~ - (d) "ZONIN~ AMENDMENT ORDINANCE 2 82-28" (i) "A RESOLUTION GRANTING A USE PERMIT TO LA PETITE ACADEMY, INC. TO CONSTRUCT ' ~..:ANDiOPERATE A CHILD DAYCARE CENTER AT 5851 TRUCKER STREET. WHEREAS, Monogram Real Estate Counselors, Inc. by Robert G. Rogers, on behalf of La Petite Academy, Inc., has made application pursuant to Section 40-79(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in don~'c~t'io~ with said application; and WHEREAS,, the p~anning Commission has recommended the NOW, THEREFORE, BE IT RESOLVED by the Council of the 1. That ~th'e use for which the use permit is sought: granting of said use permit. City of Portsmouth, Virginia: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b] Will not be ~detrimental to the public use or injurious to the property or improw ment;S'ih th~ neighborhood; and (c) Will:be in accordance with the purposes of the Zoning Chapter of the City Code. d , 2. La Petite Aca emy, Inc. is hereby granted a use permit pursuant to Section 40-79[b) of the City Code to operate a child daycare center at the property described as follows: UP 82-20 Beginnigg at the southwest intersection of Trucker Street and property of'-the~Seaboard~ Coast Line Railroad Company; thence west along the southern boundary of Trucker Street 215 feet to a point; thence south and parallel with the property of Seaboard Coast Line Railroad 143 feet to a point; thence east and parallel witB Trucker Street 215 feet to a point on the boundary of the Se~board'C6ast Line Railroad proper~y; thenze north along the boundary of Seaboard Coast Line Railroad property 143 feet to the point of beginning. 3. : ~his ose permit is approved subject to the following conditions: (a) No more than 100 children will be cared for in this facility ~. (b) The'~'f~ncing along Trucker Street. shall be ~ive (5) feet high masonry ty~e f~h~$' to completely screen the yard from the street. at any one time. of solid wood or (c) The outdoor play area will be not less than 10,000 square feet in size. (d) All interior operations of this facility will be conducted of 6:00 A. M. and 6:00 P. M.. only between the hour~ (~) ~11 exterior playyard facilities will be used only between the hours of 8:00 A.M and 6:00~ P; M.. (f) The location of dumpsters shall be approved by the Department of Public Works prior to installation. (g) All health, fire and building co~es must be me~ prior to commencement of opera2 tions of the facility. (h) The applicant shall comply with all codes, ordinances, policies and regulations of federal, state and local governments that may be applicable, and shall have obtained all necessary licenses and permits required for this use. -'<i~This use permit is issued to La Petite Academy, Inc. and is not transferrable to any other person, entity or corporation. (j) Ail delivery and pickup of children attending the daycare center shall be on-sit~ within the fenced area of the facility. No children shall be discharged or picked up on Truck~ Street." -
