226 <br /> <br />January 11, 1983 <br /> <br />(j) "A RESOLUTION GRANTING A USE PERMIT TO ROSELLA CHESTNER TO OPERATE AN ADULT <br /> GROUP RESIDENCE AT 502 HOWARD STREET. <br /> <br /> WHEREAS, Rosella Chestner, has <br />of the City of Portsmouth, Virginia, <br />described; and <br /> <br />made application pursuant to Section 40-78(b) of the Code <br />1973, for the granting of a use permit as hereinafter- <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, B~ IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />(1) That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or im- <br />provements in the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Rosella Chestner is hereby granted a use permit pursuant to Section 40-78(b) of <br />the City Code to operate an adult group residence at the property described as follows: <br /> <br />UP..82-21 <br /> <br /> All that certain parcel of land known according to the present street <br />numbering system of the City of Portsmouth as 502 Howard Street, beginning on <br />the south side of Howard Street 120 feet, more or less, east from the intersection <br />of Howard Street and Wool Avenue; thence easterly 88.60 feet; thence southerly <br />100.O9 .feet; thence westerly 44.15 feet; thence northerly 109.44 feet to the <br />point of beginning. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br /> (a) The adult group residence may be operated for not more than four (4) adult <br />residents. <br /> <br /> (h) The applicant shall comply with all codes, ordinances, <br />of federal, state and local governments that may be applicable, and <br />the necessary licenses and permits as required-for this use. <br /> <br />policies and regulations <br />shall have obtained all <br /> <br /> (c) This permit is issued to Rosella Chestner and is not transferrable to any other <br />person or entity." <br /> <br />(k) "A RESOLUTION GRANTING A USE PERMIT TO ALLIANCE CHRISTIAN CHURCH TO CONSTRUCT <br /> AN ADDITION TO THE CHURCH AND SCHOOl BUILDING FACILITIES AT 5809 PORTSMOUTH <br /> BOULEVARD. <br /> <br /> WHEREAS, Alliance Christian Church, by Reverend Earl Freeland, <br />pursuant to Section 40-77(b) of the Code of the City of Portsmouth, <br />granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all <br />done in connection with said application; and <br /> <br />has made application <br />Virginia, 1973, for the <br /> <br />things required to be <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT~RBSOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will <br />the neighborhood of the prgposed use; <br /> <br />not adversely affect the health and safety of persons residing or working <br /> <br /> (b) Will not be detrimental to the <br />provements mn the neighborhood; and <br /> <br />(c) Will be in accordance with the <br /> <br />public use or injurious to the property or im- <br />purposes of the Zoning Chapter of the City Code. <br /> <br /> 2, Alliance Christian Church is hereby granted a use permit <br />of the City Code to construct an addition to the church and school <br />mouth Boulevard on property described as follows: <br /> <br />pursuant to Section 40-77(b <br />facilities at 5809 Ports- <br /> <br />UP 82-22 <br /> <br /> Beginning on the southside of Portsmouth Boulevard 1OO1.12 feet west from <br />its intersection with Elmhurst Lane; thence south 150 feet, more or less; thence <br />southerly 30 feet, more or less; thence southeasterly 267.3 feet; thence southerly <br />110 feet, more or less; thence east 115 feet; thence southwesterly 130 feet, more <br /> <br /> <br />
