226 January 11, 1983 (j) "A RESOLUTION GRANTING A USE PERMIT TO ROSELLA CHESTNER TO OPERATE AN ADULT GROUP RESIDENCE AT 502 HOWARD STREET. WHEREAS, Rosella Chestner, has of the City of Portsmouth, Virginia, described; and made application pursuant to Section 40-78(b) of the Code 1973, for the granting of a use permit as hereinafter- WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, B~ IT RESOLVED by the Council of the City of Portsmouth, Virginia: (1) That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or im- provements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Rosella Chestner is hereby granted a use permit pursuant to Section 40-78(b) of the City Code to operate an adult group residence at the property described as follows: UP..82-21 All that certain parcel of land known according to the present street numbering system of the City of Portsmouth as 502 Howard Street, beginning on the south side of Howard Street 120 feet, more or less, east from the intersection of Howard Street and Wool Avenue; thence easterly 88.60 feet; thence southerly 100.O9 .feet; thence westerly 44.15 feet; thence northerly 109.44 feet to the point of beginning. 3. This use permit is approved subject to the following conditions: (a) The adult group residence may be operated for not more than four (4) adult residents. (h) The applicant shall comply with all codes, ordinances, of federal, state and local governments that may be applicable, and the necessary licenses and permits as required-for this use. policies and regulations shall have obtained all (c) This permit is issued to Rosella Chestner and is not transferrable to any other person or entity."
