<br /> "On December 14, 1982, the Council appointed viewers to consider the application to
<br />vacate, close and discontinue a 16-foot alley on the east side of Tyre Neck Road running
<br />parallel to Trucker Street in the Churchland area of the City. The application £or closure
<br />of the alley is being made in connection with the development of a child day care center, which
<br />Council has previously considered and approved a use permit for. The viewers report, a copy
<br />of which is attached, recommends approval of the closure of this allay. Upon adoption of the
<br />attached ordinance closing this alley as a public way, the adjoining property owners to the
<br />north and south of it will each have title to an additional 8 feet of property.

<br /> I recommend adoptmon of the attached ordinance closing the 16-foot alley if a mutually
<br />agreeable value of the easement can be determined."

<br />Motion of Mr. Gray and seconded by Mr. Beamer, to adopt the ordinance.

<br /> Substitute motion of Mr. Whitlow and seconded by Mrs. Webb, that the matter be deferred
<br />for two weeks (February 8, 1983), and was adopted by unanimous vote.
<br />
<br /> 83-29 "Letter from the City Manager recommending adoption of a resolution accepting
<br />the proposal of J. Ovid ~eene to purchase certain City owned property (old Winchester Drive
<br />Fire Station); diyF~ting the City Manager to convey subject to such conditions as he deems
<br />appropriate."

<br /> "As previously discussed, the proposal of J. Ovid Keene to purchase the Old Winchester
<br />Drive Fire Station property for the sum of $46,350.00 for the purpose of redeveloping the
<br />property for commercial and business purposes was the highest of two bids received.
<br />
<br /> Mr. Keene has been advised that in addition to the requirement to remove the present
<br />structures and to rebuild for commercial and business purposes, the following condi~i6ns will
<br />be included in the contract and the deed for this property:
<br />
<br /> 1. The City reserves the right to approve such site plan and, in the event approval
<br />not obtained, the City retains the option to repurchase the property for the bid price of
<br />$46,350.00.

<br /> 2. Within a reasonable time after conveyance of the prcperty the existing buildings
<br />shall be demolished and the purchaser shall have under construction the proposed new buildings
<br />after having obtained all the necessary permits for such construction. In the event this
<br />condition is not accomplished, the City reserves the right to repurchase the property for the
<br />bid price of $46,350.00.

<br /> 3. The property's'shall not be used or conveyed in any manner which would result in the
<br />property or any improvements thereon being granted a nontaxable status as provided by law.
<br />
<br /> Mr. Keene has expressed his consent to these additional conditions.
<br /> On the regular Agenda tonight is a resolution to accept the proposal of Mr. Keene and to
<br />authorize me to convey the property subject to these condiaions. I recommend~spprova] of th~
<br />resolution.'
<br /> On motion of.'.Mr~. Webb and seconded by Mr. Whitlow, the following resolution was adopted,
<br />and by the following vote:
<br /> "A RESOLUTION ACCEPTING THE PROPOSAl OF J. OVID KEENE TO PURCHASE CERTAIN CITY-OWNED
<br /> PROPERTY (OLD WINCHESTER DRIVE FIRE STATION): AUTHORIZING THE CITY ~NAGER TO CONVEY
<br /> SUBJECT TO SUCH CONDITIONS REGARDING USE AND DEVELOPMENT OF THE PROPERTY AS ~Y BE
<br /> DEEMED APPROPRIATE.
<br />
<br /> WHEREAS, pursuant to an advertisad notice of sale of the hereinafter-described property
<br />known as the Old W~nchester Drive Fire Station, bids for puchase and development of said
<br />property were received on December 13, 1982; and
<br />
<br /> WHEREAS, the highest bid received was the proposal of J. Ovid Keene to purchase the
<br />subject property and the improvements thereon for the sum of $46,350.00 and to remove the
<br />present structures and redevelop the property for business and commercial use; and
<br />
<br /> WHEREAS, it is the opinion of City Council that sale of the property for such use would
<br />be in the best interest of the City.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the proposal of J. Ovid I(eene to purchase the~hereinafter-described property for the sum of
<br />$46,350.00; to remove the existing structure; and to redevelop the property for commercial and
<br />business use, be and the same hereby is, accepted.
<br />
<br />The property to be conveyed is described as follows:
<br />
<br /> All that certain piece or parcel of land, situate, lying and.being in the City
<br />of Portsmouth, Virginia, with the buildings and improvements thereon, known, numbered
<br />and designated as Lots 1, 2, 3, 4, 5 and 6, Block 10, revised plat of Blocks 3, 5, 8
<br />and 9, Seciion 1, Plat of Grove Park, recorded in the Clerk's Office of the Circuit
<br />Court of the City of Chesapeake, Virginia, in Map Book 21, Page 2.
<br />
<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute
<br />such contracts, deeds and other documents as may be required to complete this transaction and
<br />to include among the terms of such contracts, deeds or other documents such appropriate terms
<br />and conditions pertaining to the use and development of said property as he m~y deem
<br />appropriate."
