297 <br /> <br />~¥ lO, 1983 <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE EASEMENTS FOR PUBLIC <br /> UTILITIES IN THE PORTION OF EIGHTH STREET AND GARFIELD STREET. <br /> <br /> WHEREAS, by Ordinance adopted by the Council of the City of Portsmouth, Virginia on <br /> December 12, 1978, recorded in Deed Book 746, page 334 in the Clerk's Office of the Circuit <br /> Court of the City of Portsmouth, Virginia, a portion of Eighth Street between Fayette Street <br /> and Madison Street was closed as a public street; and · <br /> <br /> WHEREAS, by Ordinance adopted by the Council of the City of Portsmouth, Virginia on <br />November 25, 1980, recorded in Deed Book 798, page 311 in the Clerk's Office of the Circuit <br />Court of the City of Portsmouth, Virginia, a portion of Garfield Street between Nineth Street <br />and Green Street was closed as a public street; and <br /> <br /> WHEREAS~ pursuant to the terms of said ordinances the City of Portsmouth reserved an <br />easement for the purpose of installation, maintenance, operatJon of sewer mains, sewer drains, <br />sanitary sewers, storm drains, water mains and laterals and electric power lines within, over, <br />under and across said portions of the streets; and <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority has requested that said easements <br />be released; and <br /> <br /> WHEREAS, said utilities have been relocated and the City no longer requires access to sai~ <br />streets for the purpose of operating said utilities. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Manager be, and he hereby is, authorized to execute a deed of release for the utility <br />easements retained in that portion of Eighth Street which was closed by Ordinance of this <br />Council adopted December 12, 1978 and that portion of Garfield Street which was closed by <br />Ordinance adopted by this Council on November 25, 1980." <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 83-179 Letter from <br />the City Manager to grant <br />~ir~inia (Cedar Lane Fire <br /> <br />the City Manager recommending adoption of a resolution authorizing <br />an easement to the Chesapeake and Potomac Telephone Company of <br />Station). <br /> <br /> "rhe C 8 P Telephone Company, in connection with recen~ street improvements made at the <br />intersection of High Street and Cedar Lane for the upgrading of s~ervice for customers in that <br />vicinity, has requested a~ easement to install a junction box and primeter underground cable <br />service in the vicinity of the Cedar Lane Fire Station. This installation will also provide <br />service to the Fire Station as well as the Coleman Nursery Vacility. The easement agreement <br />will contain provisions that the C & P Telephone Company will hold the City harmless from any <br />claims or damages involv~i~g mns~allation or operation of the system and will relocate the <br />equipment at no cost to the City if future development of the Fire Staticn property is necess <br /> <br /> The Fire Department has indicated that the prcposed easement and installation willy,not <br />affect its operation. I have attached a copy of a resolution prepared by the City Attorney <br />and a diagram of the easement location along the northern and eastern boundary of the Fire <br />Station property. <br /> <br /> I would, therefore, recommend Council's adoptio~ of the resolution <br />e~ecut~on of the necessary deeds of easement and other documents as may <br />the transaction." <br /> <br />authorizing the <br />be necessary to compl~ <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, the ~ollowing resolution was adopted, <br />and by the following vote: <br /> <br /> "A RESCLUTION AUTHORIZING THE CITY MANAGER TO GRANT AN EASEMENT TO THE CHESAPEAKE <br /> AND POTOMAC TELEPHONE COMPANY OF VIRGINIA (CEDAR LANE FIRE STATION PROPERTY). <br /> <br /> WHEREAS, the Chesapeake and Potomac Telephone Company of Virginia has requested the City <br />of Portsmouth to grant an easement along the northern and eastern boundary of City-owned <br />property on Cedar Lane for the purpose of installing underground telephone utility cables; and <br /> <br /> ~HEREAS, the installation of said equipment is being made in connection with [mprovements <br />to Cedar Lane and for upgrading service of the customers of the Chesapeake and Potomac Tele- <br />ph.one Company of Virginia; and <br /> <br /> WHEREAS, the installation of said equipment will not interfere with the operation of the <br />Cedar Lane Fire Station; and <br /> <br /> WHEREAS, the Chesapeake and Potomac Telephone Company of Virginia shall agree to relocate <br />or remove its facilities, at no cost to the City, if future development of the Cedar Lane Fire <br />Station shall require the same to be removed or relocated. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virgxnia, that <br />the City Manager be, and he hereby is, authorized to grant an easement to the Chesapeake and <br />Potomac Telephone Company of Virginia over, under and across the hereinaEter-described propert <br /> <br /> <br />
