309 <br /> <br />May 24, 1983 <br /> <br /> WHEREAS, the Virginia Litter Control Act of 1976 provides, through the Department of <br />Conservation and Economic Development, Division of Litter Control, for the allocation of public <br />funds in the form of grants for the purpose of enhancing local litter control problems; and <br /> <br /> WHEREAS, the City of Portsmouth is eligible to submit a grant application for funding, for <br />1983 pursuant to the regulations governing the administration and use of such funds, and has <br />reviewed and considered the regulations and applications covering administration and use of <br />said funds. <br /> <br /> NOW, THEREFDRE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that th <br />Council does hereby endorse the Clean Community Program of the Beautification and Clean Com- <br />munity Commission for the City of Portsmouth, Virginia. / <br /> <br />~ BE ~T F~RTHE~ ~ESpLVE~ tha~ t~e Council for the City of Portsmouth authorizes the City l <br />manager to p±an, Du~get an~ apply for a Grant which, if approved, will be used to fund sai~ ~ <br />program and hereby requests the Department of Conservation and Economc Development, Division o~ <br />Litter Control, to consider and approve the application and program, said program being in <br />accord with the regulations governing the use and expenditure of such funds." <br /> <br />Ayes: Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 83-206 <br />amendment to <br />Virginia. <br /> <br />Letter from the City Manager recommending adoption of a resolution providing <br />the Articles of Incorporation of the Southeastern Publiz Service Authority of <br /> <br />for <br /> <br /> "The Southeastern Public Service Authority (SPSA) has submitted a request to the City <br />to approve an amendment ~o the SPSA Articles of Incorporation. The prcposed amendment would <br />permit the execution of a contract between the Authority and Suffolk to provide for the estab- <br />lishment and operation o~ a regional landfill in Suffolk. Attached is a copy of SPSA's reques~ <br /> <br /> :Prior to acting on the proposed amendment <br />hearing notice has been scheduled for your May <br /> <br /> On motion of Mr. Gray and seconded by Mr. <br />and by the following vote: <br /> <br />a public hearing is required. Therefore, the <br />24th meeting." <br /> <br />Beamer, the following resolution was adopted, <br /> <br />"~$~L[iZLON PROVIDING FOR AMENDMENT TO THE ARIICLES OF INCORPORATION OF THE <br />SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF VIRGINIA. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth: <br /> <br /> 1. That the City of Portsmouth (the "City") has found and determined and does hereby <br />declare that: <br /> <br /> (a) The cities of Chesapeake, Franklin, Norfolk, Portsmouth, Suffolk and Virginia <br />Beach and the counties of Isle of Wight and Southampton have heretofore created the South- <br />eastern Public Service Authority of Virginia (the "Authority") pursuant to the provisions of <br />the Virginia;Water and Sewer Authorities Act, being Chapter 28, Title 15.1 of the Code of <br />Virginia, 1950, as amended, in the manner and for the purposes set forth therein. <br /> <br /> (b) By certificate of amendment ~ssued and admitted to record in the office of the <br />State Corporation Commission of the Commonwealth of Virginia on January 23, 1976, the Articles <br />of Incorporation of the Apthority were amended so as to change the name of the Authority and s( <br />as to amend its purposes in certain respects. <br /> <br /> (c) The City, together with the other members of the Authority, now desires to furthe] <br />amend the Articles of Incorporation of the Authority by approval of the Articles of Amendment <br />of the Southeastern Public Service Authority of Virginia set forth below, in accordance with <br />the provisions of ~15.1-1£50 (o) of the Code of Virginia, 1950, as amended: <br /> <br /> ARTICLES OF AMENDMENT <br /> OF tHE <br />SOUIHEASTERN PUBLIC:SE~VIGE/R~THOR!T~OF'FIRGINIA <br /> <br /> The Articles of Incorporation of the Southeastern Public Service Authority of Virginia, a <br />amended, shall be further amended by striking out section (d) and substituting the following: <br /> <br /> (d) The purposes for which the Authprity is to be formed are to acquire, finance, <br />construct, operate and maintain a water system and a garbage and trash collection and disposal <br />system, all pursuant to the provisions of the Virginia Water and Sewer Authorities Act. <br /> <br /> The Authority may contract with the incorporating political subdivisions, any <br />sanitary district thereof or any authority therein created pursuant to the Act to furnish wate: <br />service and garbage and tXash collection and disposal service upon such terms as the Authority <br />shall determine; provided, however, that the same schedule of service rates shall be applic- <br />able to all such political subdivisions unless the Authority, by unanimous consent of its <br />members, authorizes different service rates for any one or more of them. The Authority is <br />expressly prohibited from contracting with any other party desiring a supply of water except <br />upon the written consent of the city or county within the geographical boundary of which such <br />party is located. <br /> <br /> Pending completion of the necessary engineering studies and estimates, it is not <br />practicable to set forth herein preliminary estimates of capital costs and initial rates for <br />services of proposed projects. <br /> <br /> <br />
