<br /> Motion of Mr. Barnes and seconded by Mr. Nolley, the approval of Cox Cable's interim
<br />rate increase and approval of an additional 2.29 ~ncrease due to changes in copyright royalty
<br />fees, and to include conditions as recommended by the City Manager, was adopted by unanimous
<br />vote.

<br /> 83-214 Letter from the City Manager recommending authorization to allow outdoor per-
<br />formance at Frank D. Lawrence Stadium.
<br />
<br /> 'On May 24, 1985, Mr. Bill Douthat of Whisper Concerts appeared before City Council
<br />requesting that Frank D. Lawrence Stadium again be used for concerts. As Council is aware,
<br />the use of this facility for outdoor concerts has in the past created several problems for
<br />the general populace. In a review with Mr. Douthat and various officials of the City, it is
<br />felt that with proper~controls, available parking, and the marketing of the existence of
<br />parking sites by the promoter, as well as restrictions on the time of the concerts; that the
<br />use of this facility for outdoor concerts could be reinstituted.

<br /> It ms, therefore, recommended that City Council authorize the City Manager to sign an
<br />agreement with the officials of Whisper Concerts to allow one concert in August and to deter-
<br />mane from this concert whether future concerts should also be held if the problems can be
<br />eliminated and controlled. There is a possibility of potential revenue to the City of approxi
<br />mately $45,000 per concert. '

<br /> Motion of Mr. Barnes and seconded by Mr. Gray, that authorization be granted to enter
<br />into agreement with Whisper Concerts, as requested, and was adopted by 4-1(Nay-Webb)vote.

<br />REPORTS FROM THE CITY MANAGER

<br /> 83-227 Letter from the City Manager recommending adoption of an ordinance on first
<br />reading to appropriate $269,400 from the Capital Improvements Fund for the construction of the
<br />Water Street Sewage Pumping Station; and, award of contract to the lowest responsible bidder.
<br />
<br /> "The 1982z87 Capital Improvement Program authorized $700,000 in the current fiscal year
<br />for construction of a sewage pumping station and sewer lines to serve the recently expanded
<br />Holiday Inn and the new high rise apartments. Design of this project was funded from a previm
<br />appropriation. The appropriation tonight would fund construction of a pumping station on
<br />Water Street.

<br /> Although there as a large difference between the City estimate and the low bid, the
<br />Director of Public Utilities is satisfied with theccapability of the low bidder to perf6rm the
<br />work. Therefore, the Director has recommended appropriating the necessary funds and awarding
<br />the contract to Luke Construction Company, Inc. The total anticipated project cost, including
<br />contigencies and inspection, is $269,400, and I recommend an apprpriation in that amount."

<br /> On motion of Mr. Barnes and seconded by Mrs. Webb, the following ordinance was approved
<br />on first reading, and the City Manager'~be authorized to award the bid to the lowest resnonsibl~
<br />bidder, Luke Construction Company, and was adooted by unanimous vote:

<br /> "The 1982~87 Capital Improvement Program indicates $541,925 remains from prior authori-
<br />zations for interior renovations to the 1846 Courthouse. In addition, the Virginia General
<br />Assembly has appropriated S150,000 in 1982z83 and S100,000 in 1983~84 ~o reimburse the City
<br />for construction costs. Bids were received as follows:
