349 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the Use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property and im- <br />provements in the neighborhood; and <br /> <br /> (c) Wilt be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Linda Grimes is hereby granted a use permit pursuant to .§40-70(b) of the City code <br />to operate a drop-off baby sitting service at 4805 Portsmouth Boulevard, such parcel being <br />0.75 acres and being more specifically described as Tax Plate 443, Parcel 11. <br /> <br /> S. This use permit is approved subject to the following conditions: <br /> <br /> (a) All applicable building, health and fire codes must be met prior to the issuance <br />of an occupancy permit for the proposed use; <br /> <br /> (b) The maximum number of children to be cared for at any one time should not exceed <br />twenty-five (25) unless a smaller number is required by the Building Official or Fire Marshal <br /> <br /> (c) Should this use operate as caring for children on a regular basis, all state and <br />local codes applicable to childcare centers must be met. <br /> <br /> (d) The proposed 60' x 40' fence play area must be adequately screened either by a <br />wooden stockade fence or suitable landscaping so as to buffer adjoining residences. The <br />fenced area must be built prior to the obtaining of a business license to operate the facilit~ <br /> <br /> (e) The use permit is issued to Linda Grimes, 4805 Portsmouth Boulevard and is not <br />tr. ansferr~b~e~o any other person, entity or location. <br /> <br /> (f) Prior to obtaining a business license, the applicant shall: <br /> <br /> 1. Obtain the necessary inspection by the Fire, Health and <br />and correct any deficiencies identified by these inspectors; <br /> <br />Building <br /> <br />Officials <br /> <br /> 2. Surface with bituminous or portland cement concrete the circular drive and <br />parking area in front of the facility." <br /> <br />(i) "A RESOLUTION GRANTING A SPECIAL EXCEPTION TO DINWIDDIE PLAZA APARTMENTS FOR <br /> OFF-STREET PARKING IN rHE DOWNTOWN D-1 DISTRICT. <br /> <br /> WHEREAS, Dan E. Griffin, agent for Dinwiddie Plaza Hotel, has made application for the <br />granting of a special exception to the off-street parking requirements for the Dinwiddie Plaza <br />Hotel pursuant to §40rI2Z (5) (c) in the Downtown D-1 District; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has made a recommendation for the granting of a special <br />exception to the off-street parking requirements. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the special exception to be granted: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />the neighborhood; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or improw <br />ments in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes and objectives of the Downtown D-1 District. <br /> <br /> 2. Dinwiddie Plaza Hotel is hereby granted a special exception to <br />requirements to the Downtown D-I District as provided for in <br />ception being approved subjec~ to the following conditions: <br /> <br />the off-street parkin <br />(c), suchvspe~al:~ex- <br /> <br /> ~) ~e.ce:x~§t.in~Dq.nwiddie Hotel and the adjacent proper~y currently being used as <br />the Hotel's p~rking lot will be developed into a 199 unit apartment complex for elderly and <br />retired persons. <br /> <br /> (b) The developer shall provide 19 spaces on site of the new complex and at least 10 <br />additional spaces in the City-owned parking lot on King Street. <br /> <br /> (c) After one (1) year the City reserves the Tight to ~re~evaluate the need for addi- <br />tional parking and based upon the recommendation of the Traffic Engineer can increase or de- <br />crease the amount of parking needed for the project up to but not exceeding the requirements <br />provided for in §40-~21 (4). <br /> <br /> <br />
