360 <br /> <br />August 9, 1983 <br /> <br /> "AN ORDINANCE TO AMEND ARTICLE II OF CHAPTER 21 OF THE CODE OF THE CITY OF <br /> PORTSMOUTH, VIRGINIA, 1973, AS ~ANDED, BY ADDING THERETO, SECTIONS 21-18.1 <br /> AND 21-18.2 PERTAINING TO IMITATION CONTROLLED SUBSTANCES." <br /> Ayes: Barnes, Beamer, Gray, Holley, Webb, ~qhitlow, Johansen <br /> Nays: None <br /> 83-306 - Letter from the City Manager recommending adoption of a motion to refund <br />$3~550.50 to National Linen Service for tax paid in error for gas service provided by <br />Commonwealth Gas Company. <br /> "The'owner of the National Linen Service, located at 3325 Victory Boulevard, has <br />requested a refund of utility tax paid in error for gas service provided by Commonwealth <br />Gas Company. The amount of the refund is $3,550.50. <br /> The National Linen Service has two meters for gas service as installed by Commonwealth <br />Gas Company at the same location. Section 35-114(c) of the City Code provides that the tax <br />for electric or gas service shall be 20% of the first $2,000 billed for each billing period <br />for each purchaser. National Linen service should only be classified as one "purchaser" <br />for gas utility service even though two meters are located at the same address. <br /> I would recommend adoption of the motion." <br /> Motion of Mr. Gray and seconded by Mr. Beamer, that authorization be granted to refund <br />to National Linen Service $3,'550.50 for utility tax paid in error, and was adopted by unani- <br />mout vote. <br /> 83-307 - Letter from the City Manager recommending adoption of a motion to refund <br /> $121.60 to Lee S. Dunn for over-assessment on personal property taxes for years 1980, 1981 <br /> and 1983. <br /> "The Commissioner of the Revenue has requested the partial refunding of Personal Propert <br /> taxes for the years 1980, 1981 and 1983 to Lee S. Dunn, 4511 Portsmouth Boulevard, Portsmouth <br /> Virginia 23701. Mr. Dunn was over-assessed on his Motor Home for these three years due to <br /> insufficient information. <br /> <br />The adjustments for partial refunds are as follows: <br /> <br />1980 $ 45.60 <br />1981 41.60 <br />1983 - 34.40 <br /> <br /> It is hereby requested ~hat a refund for $I21.60 be issued to Mr. Dunn." <br /> Motion of Mr. Beamer and seconded by Mr. Gray, that authorization be granted to refund <br />to Lee S. Dunn $121.60 for over-assessment on personal property taxes, and was adopted by <br />unanimous vote. <br /> <br /> 83-308 Letter from the City Manager recommending adoption of a motion to refund <br />$52.73 to Coleman and Gloria Chatman for incorrectly assessed real estate taxes during the <br />fiscal years 1979-80 through 1981-82. <br /> "Coleman and Gloria Chatman of 2518 Chestnut Street have been incorrectly assessed real <br />estate taxes during the fiscal years 1979-80 through 1981-82 in the amount of $24.56. this <br />error resulted from a transfer oversight on August 13, 1953. <br /> It is, therefore, necessary to rebate rhe taxes, interest and penalty paid in error <br /> <br />totalling $52.73 as <br /> <br />follows: <br /> <br />Taxes $24.56 <br />Interest 21.02 <br />Penalty -.15 <br />Total $52.73 <br /> <br /> Based on the recommendation of the City Assessor, I <br />to make this refund." <br /> Motion of Mr. Beamer and seconded by Mr. Gray, that <br />~o Colemand and Gloria Chatman $52.73, as requested, for <br />taxes, and was adopted by unanimous vote. <br /> <br />recommend adoption of a motion <br /> <br />authorization be granted To refund <br />incorrectly assessed real estate <br /> <br /> 83-309 Letter from the City Manager recommending adoption of a motion to transfer <br />$7,600 from the Grants Contingency &ccount as follows: <br /> <br /> 1. $500 matching gran~ from Virginia Commission for the Arts for the printing <br /> and mailing of 15,000 project discriptions and applications. <br /> <br /> 2. $5,000 ~on-matchi~g grant from Virginia Commission for the ARts [or general <br /> operating expenses. <br /> <br /> 3. $2,100 matching grant from Virginia Foundation for the Humanities and Public <br /> Policy for the expenditure of a ten (10) session lecture series. <br /> <br /> <br />
