360 August 9, 1983 "AN ORDINANCE TO AMEND ARTICLE II OF CHAPTER 21 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS ~ANDED, BY ADDING THERETO, SECTIONS 21-18.1 AND 21-18.2 PERTAINING TO IMITATION CONTROLLED SUBSTANCES." Ayes: Barnes, Beamer, Gray, Holley, Webb, ~qhitlow, Johansen Nays: None 83-306 - Letter from the City Manager recommending adoption of a motion to refund $3~550.50 to National Linen Service for tax paid in error for gas service provided by Commonwealth Gas Company. "The'owner of the National Linen Service, located at 3325 Victory Boulevard, has requested a refund of utility tax paid in error for gas service provided by Commonwealth Gas Company. The amount of the refund is $3,550.50. The National Linen Service has two meters for gas service as installed by Commonwealth Gas Company at the same location. Section 35-114(c) of the City Code provides that the tax for electric or gas service shall be 20% of the first $2,000 billed for each billing period for each purchaser. National Linen service should only be classified as one "purchaser" for gas utility service even though two meters are located at the same address. I would recommend adoption of the motion." Motion of Mr. Gray and seconded by Mr. Beamer, that authorization be granted to refund to National Linen Service $3,'550.50 for utility tax paid in error, and was adopted by unani- mout vote. 83-307 - Letter from the City Manager recommending adoption of a motion to refund $121.60 to Lee S. Dunn for over-assessment on personal property taxes for years 1980, 1981 and 1983. "The Commissioner of the Revenue has requested the partial refunding of Personal Propert taxes for the years 1980, 1981 and 1983 to Lee S. Dunn, 4511 Portsmouth Boulevard, Portsmouth Virginia 23701. Mr. Dunn was over-assessed on his Motor Home for these three years due to insufficient information. The adjustments for partial refunds are as follows: 1980 $ 45.60 1981 41.60 1983 - 34.40 It is hereby requested ~hat a refund for $I21.60 be issued to Mr. Dunn." Motion of Mr. Beamer and seconded by Mr. Gray, that authorization be granted to refund to Lee S. Dunn $121.60 for over-assessment on personal property taxes, and was adopted by unanimous vote. 83-308 Letter from the City Manager recommending adoption of a motion to refund $52.73 to Coleman and Gloria Chatman for incorrectly assessed real estate taxes during the fiscal years 1979-80 through 1981-82. "Coleman and Gloria Chatman of 2518 Chestnut Street have been incorrectly assessed real estate taxes during the fiscal years 1979-80 through 1981-82 in the amount of $24.56. this error resulted from a transfer oversight on August 13, 1953. It is, therefore, necessary to rebate rhe taxes, interest and penalty paid in error totalling $52.73 as follows: Taxes $24.56 Interest 21.02 Penalty -.15 Total $52.73 Based on the recommendation of the City Assessor, I to make this refund." Motion of Mr. Beamer and seconded by Mr. Gray, that ~o Colemand and Gloria Chatman $52.73, as requested, for taxes, and was adopted by unanimous vote. recommend adoption of a motion authorization be granted To refund incorrectly assessed real estate 83-309 Letter from the City Manager recommending adoption of a motion to transfer $7,600 from the Grants Contingency &ccount as follows: 1. $500 matching gran~ from Virginia Commission for the Arts for the printing and mailing of 15,000 project discriptions and applications. 2. $5,000 ~on-matchi~g grant from Virginia Commission for the ARts [or general operating expenses. 3. $2,100 matching grant from Virginia Foundation for the Humanities and Public Policy for the expenditure of a ten (10) session lecture series.
