359 <br /> <br />August 9, 1983 <br /> <br />This resolution shall become effectiv~ from the date of its ad ' " <br /> option. <br /> Ayes: Barnes, Beamer, Gray, Holley, Webb Whitlow, Johansen <br /> Nays: None ' <br /> <br /> the <br />- and <br /> <br /> 83-304 Letter from the City Manager recommending adoption of a resolution authorizing <br />City Manager to enter ~nto a memorandum of understanding between the City of Portsmouth <br />the Virginia Port Authorit?. <br /> <br /> "For some time, officials of the Department of Economic Development, the Industrial <br />Development Authority (IDA) and the F~rginia Port Authority (VPA) have been attempting to <br />resolve, certain issues pertaining to the future development of the Port area as well as certa <br />legal issues and payments to the City contained in the existing Port Unification Contract. A <br />resolution of these issues has be~n attained as set forth in a Memorandum of Intent between t~ <br />City and Virginia Port Authority. In summary, the recommended actions to be taken are as <br />follows: <br /> <br /> 1. The City Council will convey to VPA for the sum of $40,000 title to <br /> in the underlying fee ~n the streets designated as Seaboard Avenue, <br /> Carolina ~venue, Page Street, and a portion of Southern Avenue. <br /> <br /> 2. VPA will convey to the City Council, at no cost, land necessary <br /> the expansion and upgrading of the sewage treatment plant. <br /> <br /> 3. In the future, if Hill Avenue is vacated as a public street, the <br /> agrees to convey the underlying fee to VPA at no additional cost. <br /> <br />4. The Declaratory Judgment action brought by VPA against the City Council re- <br /> lative to street closure actions will be dismissed with prejudice. <br /> <br />$. VPA will inform the Commissioner of Revenue and the City Manager of any lease <br /> or sublease on property located in the City and owned by EPA. <br /> <br />6. YPA will grant the necessary easements across its property in the event the <br /> City Council finds it necessary to construct a roadway connecting West Norfolk <br /> Bridge to Martin Luther King Freeway; provided, however, that the prcposed <br /> route must be approved in writing by VPA. In the event that VPA does not <br /> approve the proposed route, the City Council must purchase or condemn the <br /> necessary land. <br /> <br /> property <br /> Pinner Avenue, <br /> <br />to complete <br /> <br /> City Council <br /> <br /> The <br />ing into <br /> <br />7. Should <br /> the VPA acquire any property outside of the defined area, a condition of any <br /> agreement by which a private person, firm or corporation will uss such property <br /> will be that such person or firm pay annually to the City treasurer a sum or <br /> pro rata share of such sum, equivalent to the the amount of real and personal <br /> property taxes which the City Assessor would assess on such prcperty, including <br /> improvements, if the property were privately owned. <br /> <br />9. Should VPA construct an administrative facility outside of the defined Port <br /> area, the payment of real estate taxes will be equivalent to the amount <br /> to be paid if the building was privately owned. <br /> <br /> resolution on your Agenda would authorize me to conclude these negotiations <br /> a Memorandum of Understanding with the Virginia Port Authority. <br /> <br />I recommend adoption of <br /> <br />the resolution." <br /> <br />by enter- <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, to <br /> <br /> Substitute motion of Mr. Whitlow and seconded by <br /> to the next meeting (August 23, 1983), and was adopted by unanimous vote. <br /> <br /> 83-305 Letter from the City Manager recommending adoptio~ of an ordinance to amend <br />Article II of Chapter 21 of the City's Code, by adding thereto, Sections 21-18.1 and 21-18 2 <br />pertaining to imitation controlled substances. ' <br /> <br /> "The attached correspondence from the City Attorney proposes the adoption of certain <br />legislation pertaining to the sale and distribution of stimulants to minors. While it is <br />e¥ident from all available information that only legislation on the federal and/or state <br />level will curb the problem in Portsmouth and elsewhere, I join with the City Attorney in <br />recsmmending the adoption of these interim measures to control the sale and distribution of <br />"imitation controlled substances" to minors, which clearly constitutes a nuisance detrimental <br />to the health, safety and welfare of the residents of the City." <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Whitlow, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />h~ad~pted. <br /> <br />Mr. Beamer, that the matter be deferred <br /> <br /> <br />
