That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Farm Fresh Supermarkets, Inc. is hereby granted a use permit Fursuant to ~40-6S.1 <br />of the Code of the City of Portsmouth, Virginia to operate a Farm Fresh Supermarket on the <br />property designated as 1701 High Street and more particularly described as Tax Plate 113, <br />Parcel 8. <br /> <br />3. The following conditions are prescribed for this use permit: <br /> <br /> (a) Farm. Fresh Supermarkets, Inc. shall comply with all statutes, ordinancas, <br />policies and regulations of the federal, state and local governments that may be applicable so <br />the proposed use and shall have obtained all necessary licenses and permits required for this <br />USe. <br /> (b) This use permit is issued to Farm Fresh Supermarkets, Inc. and is not ~rans- <br />ferrable to any other person, entity or corporation." <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 85-301 (f) - Item Removed from tbs Consent Agenda was presented: UP 83-12 approved on firs <br />reading at the Public Hearing of August 9, 1983. <br /> Motion of Mr. Barnes and seconded by Mrs. Webb, that UP 83-12 be amended to chan~e the <br />interior operations to be conducted until 6:30 p.m. and change of name to Child Care Equities, <br />Inc., and was adopted by unanimous vote. <br /> <br /> On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution was adopted, <br />amended, and was adopted by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO CHILD CARE EQUITIES, INC. Child's World, Inc. is hereby granted a use permit pursuant to §40-79 (b) of the <br />City Code to operate a child daycare center at 5700 Trucker Street and more particularly <br />described as a portion of Parcel 1 of Tax Plate 815 containing approximately .74 acres (UP-82-2 <br /> <br />~,~ Thi~ use permit is approved subject to the following conditions: <br /> <br /> (a) No more than 102 children will be carsd for in this facility in any one time; <br /> <br /> (b) The fencing encompassing the outdoor play area sh~ll be at least five feet (5') <br />high, solid wood or masonry type; <br /> <br /> (c) Ail interior operations of this facility will be conducted only between the hour~ <br />of 6:00 A.
