365 August 23, 1985 WHEREAS, the applicant and the Planning Director have done all things required to oe done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORe, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Farm Fresh Supermarkets, Inc. is hereby granted a use permit Fursuant to ~40-6S.1 of the Code of the City of Portsmouth, Virginia to operate a Farm Fresh Supermarket on the property designated as 1701 High Street and more particularly described as Tax Plate 113, Parcel 8. 3. The following conditions are prescribed for this use permit: (a) Farm. Fresh Supermarkets, Inc. shall comply with all statutes, ordinancas, policies and regulations of the federal, state and local governments that may be applicable so the proposed use and shall have obtained all necessary licenses and permits required for this USe. (b) This use permit is issued to Farm Fresh Supermarkets, Inc. and is not ~rans- ferrable to any other person, entity or corporation." Motion of Mr. Barnes and seconded by Mrs. Webb, that UP 83-12 be amended to chan~e the interior operations to be conducted until 6:30 p.m. and change of name to Child Care Equities, Inc., and was adopted by unanimous vote. On motion of Mr. Gray and seconded by Mrs. Webb, the following resolution was adopted, amended, and was adopted by the following vote: "A RESOLUTION GRANTING A USE PERMIT TO CHILD CARE EQUITIES, INC. TO CONSTRUCT AND OPERATE A CHILD/DAYCARE CENTER AT 5700 TRUCKER STREET. WHEREAS, Larry Turner, President of Child Care Equities, Inc., contract owner for the Trucker Group, has made application pursuant to ~O~?R (b) of the Code of the City of Portsmoutl Virginia, 1973, for the granting of a use permit as hereinafter-described~ and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommendeJ the ~ranting of said use permit; and WHEREAS, a similar application was approved the same property by a resolution granted by the materialize. for La Petite Academy, Inc. Child's World, Inc. is hereby granted a use permit pursuant to §40-79 (b) of the City Code to operate a child daycare center at 5700 Trucker Street and more particularly described as a portion of Parcel 1 of Tax Plate 815 containing approximately .74 acres (UP-82-2 ~,~ Thi~ use permit is approved subject to the following conditions: (a) No more than 102 children will be carsd for in this facility in any one time; (b) The fencing encompassing the outdoor play area sh~ll be at least five feet (5') high, solid wood or masonry type; (c) Ail interior operations of this facility will be conducted only between the hour~ of 6:00 A. M. and 6:30 P. M.;
