October 25, 1983 WHEREAS, Mr. and Mrs. of the City of Portsmouth, elderly persons; and Velasco has made application pursuant to ~40-75 (b) of the Code Virginia, 1973, to amend said use permit to add four (4) additional WHEREAS, the applicant and the Planning Director in connection with said application; and WHEREAS, the Planning Commission has recommended NOW,_THEREFORE, BE IT RESOLVED by the Council of 1. in the have done all things required to be done the granting of said use permit. the City of Portsmouth, Virginia: That the use for which the use permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing and working neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to property and improve- ments in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. That Mr. and Mrs. Thomas B. Velasco is hereby granted a use permit pursuant to Secti~ 40,75 Cb) of the Code of the City of Portsmouth, Virginia, 1973, to operate a private resi- dence and home for the elderly on property hereinafter-described: UP~83-21 BEGINNING at the northeast corner of Utah Street and Turnpike Road; thence northerly along Utah Street 175'; thence easterly 200'; thence southerly 175' to Turnpike Road; thence westerly 200' to Utah Street; the Point of Origin. Such property being more specifically described as 3736 Turnpike Road, Tax Plate 329, Parcel 48. 3. This use permit is approved subject to the following (a) The residence may be operated for not more than conditions: twelve (12) elderly persons. (b) The applicant shall comply with all codes, ordinances, policies and regulations of federal, state and local governments that may be applicable, must meet all building, fire and health code regulations for this use, and shall have obtained all the necessary licenses and permits as required for this use. (c) There shall be no advertising or business signs on the premises. "Odell Benton, Fire Chief, has requested the renaming of the 4000-4100 blocks of McLean Street because of the confusion created by having two (2) McLean Streets. Chief Benton sug- gests renaming of that section of McLean Street from Alexander's Corner southward to the point where it brancheg into the section of McLean Street running through Academy Park (the 4000-410 blocksj"~"Towe~ Mall Drive." The Planning ~Commission and Planning Director recommends APPROVAL ~ renaming of this section of roadway to "Tower Mall Drive" and I concur." Motion of Mr. Gray and seconded by Mrs. Webb, that the matter be referred back to the Planning Commission tn consider recommendation by Councilmen Barnes and WhitloF to rename portion of street through Academy Park instead of portion 6f ~horoUghfare coming from Ports- mouth Boulevard, and was adopted by unanimous vote. 83-396 - Letter from the Cily Manager recommending adoption of an ordinance for code change which relates to the newly adopted flood plain management regulations of the Federal Emergency Management Agency (FEMA) - National Flood Insurance Program standards. "To comply with Federal Government requirements it is necessary to appeal and'reordain Chapter 12~ of the Portsmouth City Code to bring the City into conformance with the newly adopted ~E&ood.plain management regulations of the.Federal Emergency Management Agency (FEMA).
