October 25, 1983 <br /> <br /> WHEREAS, Mr. and Mrs. <br />of the City of Portsmouth, <br />elderly persons; and <br /> <br />Velasco has made application pursuant to ~40-75 (b) of the Code <br />Virginia, 1973, to amend said use permit to add four (4) additional <br /> <br /> WHEREAS, the applicant and the Planning Director <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended <br /> NOW,_THEREFORE, BE IT RESOLVED by the Council of <br /> 1. <br /> <br />in the <br /> <br />have done all things required to be done <br /> <br />the granting of said use permit. <br /> <br />the City of Portsmouth, Virginia: <br /> <br /> That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing and working <br />neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to property and improve- <br />ments in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Velasco is hereby granted a use permit pursuant to Secti~ <br />40,75 Cb) of the Code of the City of Portsmouth, Virginia, 1973, to operate a private resi- <br />dence and home for the elderly on property hereinafter-described: <br /> <br />UP~83-21 <br /> <br /> BEGINNING at the northeast corner of Utah Street and Turnpike Road; <br />thence northerly along Utah Street 175'; thence easterly 200'; thence <br />southerly 175' to Turnpike Road; thence westerly 200' to Utah Street; <br />the Point of Origin. Such property being more specifically described <br />as 3736 Turnpike Road, Tax Plate 329, Parcel 48. <br /> <br />3. This use permit is approved subject to the following <br /> <br />(a) The residence may be operated for not more than <br /> <br />conditions: <br /> <br />twelve (12) elderly persons. <br /> <br /> (b) The applicant shall comply with all codes, ordinances, policies and regulations <br />of federal, state and local governments that may be applicable, must meet all building, <br />fire and health code regulations for this use, and shall have obtained all the necessary <br />licenses and permits as required for this use. <br /> <br /> (c) There shall be no advertising or business signs on the premises. <br /> <br /> (d) Persons operating the convalescent home shall reside on the second <br />guests will be residents on the first floor. <br /> <br />floor and the <br /> <br /> ce) The use permit is issued to Mr. and Mrs. Thomas B. Chief Benton sug- <br />gests renaming of that section of McLean Street from Alexander's Corner southward to the point <br />where it brancheg into the section of McLean Street running through Academy Park (the 4000-410 <br />blocksj"~"Towe~ Mall Drive." <br /> <br /> The Planning ~Commission and Planning Director recommends APPROVAL ~ renaming of this <br />section of roadway to "Tower Mall Drive" and I concur." <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, that the matter be referred back to the <br />Planning Commission tn consider recommendation by Councilmen Barnes and WhitloF to rename <br />portion of street through Academy Park instead of portion 6f ~horoUghfare coming from Ports- <br />mouth Boulevard, and was adopted by unanimous vote. <br /> <br /> 83-396 - Letter from the Cily Manager recommending adoption of an ordinance for code <br />change which relates to the newly adopted flood plain management regulations of the Federal <br />Emergency Management Agency (FEMA) - National Flood Insurance Program standards. <br /> "To comply with Federal Government requirements it is necessary to appeal and'reordain <br />Chapter 12~ of the Portsmouth City Code to bring the City into conformance with the newly <br />adopted ~E&ood.plain management regulations of the.Federal Emergency Management Agency (FEMA). <br /> <br /> The Director of Planning, Engineering and Inspections has coordinated the internal revie~ <br />of these updated regulations and recommends adoption of'the proposed ordinance to briny t~e~ <br /> <br /> <br />
