<br />pertaining to possession of marijuana and various criminal offenses.

<br /> "Our Commonwealth Attorney has informed us of ~he conflict between the City and State
<br />Code concerning the possession of marijuana and possession of drug paraphernalia. The appro-
<br />priate charges that would be made by members of our Police Department, under such circumstanc,
<br />are not in accordance with the charges that are set by the State Code.
<br />
<br /> Additionally, we were informed of the conflict between the City and State Code pertainin
<br />to solicitation and prostitution. .In order to successfully prosecute individuals engaged in
<br />an offense of this nature both sections of ~he City Code are to be amended and reordained.
<br />
<br /> It is, therefore recommended, and I concur, that the City's Code comply and donform with
<br />the State Code by the adoption of the attached ordinance to amend Sections 21-10, 21-11 and
<br />21-18, pertaining to Controlled.Drugs and adoption of the attached ordinance to reordain
<br />Sections 21-58.1 and 21-58.2 as they pertain to Soliciting for Prostitution and/or Immoral
<br />Acts and Loitering for Those Purposes."

<br /> "City Council recently authorized that property adjacent to the Lee Avenue Fire Station
<br />be sold to,a local trucking firm. In conjunction with the transfer of this property, which
<br />is located between Lee Avenue and Industrial Avenue, the attached request for closure of a
<br />paper street has been submitted for approval.
<br />
<br /> In order to convey a single parcel to the developer it is, therefore recommended, and I
<br />concur that City Council adopt the attached resolution appointing viewers as required by the
<br />State Law."

<br />N. Kendrick, Linon Vann, H. G. Hairston, James H. Griffin and James L. Linehan be appointed
