<br />"A RESOLUTION GRANTING A USE PERMIT TO WILLI~¥1G. LEAKE TO OPERATE A WHOLESALE
<br />AUTO PARTS SALES BUSINESS AT 2201 HIGH STREET.
<br />
<br /> WHEREAS, William G. Leake, property owner, has made application pursuant to Section
<br />40-68.1 (e) of.the Code of the City of P6rtsmouth, Virginia, 1973, for the granting of a use
<br />permit as hereinafter-described; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application; and '
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council Of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working
<br />the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or im-
<br />provements in the neighborhood; and

<br />2. William G. Leake is hereby granted a use permit pursuant to §40-68.1 (e) of the City

<br />specifically described as Tax Plate 171, Parcel 12. (UP-83-20)

<br />3. This use permit is approved subject to the following condition:

<br /> WHEREAS, the Council of the City of Portsmouth, Virginia, granted a use permit to Mr. and
<br />Mrs. Thomas B. Velasco to operate a private residence and home for the elderly near Lhe inter-
<br />section of Utah Street and Kingman Avenue on January 8, 1980, which permitted no more than
<br />nine (9) elderly female 'guests in the convalescent, and nursing home; and
