November 22, 1983 <br /> <br /> 5. If violations of the use permit and/or the operation plan occur, the City Manager of <br />the City of Portsmouth or his designated representative shall be empowered to require that <br />opeation of the facility, or any part thereof, be discontinued until proper corrective action <br />has been taken. <br /> <br />(f) "ZOMING AMENDMENT ORDINANCE Z-83-27" <br /> <br />(g) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO BELINDA T. DILLARD TO OPERATE A CHILD <br />DAYCARE CENTER IN THE NOBLE STREET BAPTIST CHURCH AT 100 Noble Street. <br /> <br /> WHEREAS, Belinda T. Dillard, <br /> ~4,ty or. Portsmouth, Virginia, <br />cribbd; and <br /> <br />has made application pursuant to ~40-75 (b) of the Code of <br />1973, for the granting of a use permit as hereinafter-desr <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br />NOW, THEREFORE, BE IT RESOLVED by the CoUncil of the City of Portsmouth, Virginia: <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working in <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or improve- <br />ments in the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Belinda T. Dillard is hereby granted a use permit pursuant to §40-~75 <br />Code to operate a child daycare center in the Noble Street Baptist Church at <br />and on such property as is more particularly described herein: <br /> <br />(b) of the City <br />100 Noble Street <br /> <br />UP-83=22 <br /> <br /> Beginning at the southeast intersection of Portsmouth Boulevard and Noble Street; <br />thence south along the east right-of-way of Noble Street 270'; thence east 120'; thence <br />north 150'; thence east 120' to the west right-of-way of Grand Street; thence north <br />along said right-of-way 30'; thence west 120'; thence north 90' to the south right-of-way <br />of Portsmouth Boulevard; thence west along said right-of-way 120' to Noble Street, the <br />point of origin. <br /> <br />3. This use permit is approved sqbject to th? fgllowing conditions: <br /> <br /> (a) No more than twenty-three (23) children shall be cared for in the facility at any <br />one time. <br /> <br /> (b) The 4,818 square feet play area must be enclosed with a solid wooden fence and <br />constructed prior to operations. <br /> <br /> (c) Ail extermor play area facilities will be used only between the hours of 8:00 A.M. <br />to 6:00 P.M.. <br /> <br /> (d) All interior operations of the facility will be conducted only between the hours <br />of 6:00 A.M:. and~6~00~P2M.~;L~ <br /> <br />approved <br />center. <br /> <br />(e) Design of equipment to be installed in the outdoor play area must be reviewed and <br />by the Planning Department prior to commencement of activities of the child daycare <br /> <br />(f) Ail fire, health and building codes must be met prior to occupancy. <br /> <br /> (g) The applicant shall comply with all codes, ordinances, <br />of federal, state and local governments that may be applicable, and <br />necessary licenses and permits required for this use. <br /> <br />policies and regulations <br />shall have obtained all <br /> <br /> (h) This use permit is issued ~o Belinda T.
