¸88 <br /> <br />November 22, 1983 <br /> <br /> (1) The construction and operation of the facility; <br /> (2) The environmental controls to be provided to avoid negative environmental <br /> impacts of the facility; <br /> <br /> (3) The movement of real traffic to minimize interference with vehicular traffic. <br /> The drawings and documents shall include, but not be limited to the following: <br /> (i) All coal handling and operational facility shall be designed in such a manner <br /> as to minimize noise impacts on the adjacent residential areas; <br /> <br /> iii) Ail operation and structures shall be orientated away from the residential area <br /> in order to reduce noise impacts; <br /> <br /> (iii] The operatornshall furnish a report to the City of Portsmouth which will indica' <br /> the ambiant noise levels in the Cradock area and will compare these findings with future noise <br /> levels after commencement of operations to insure fully~that all EPA noise level requirements <br /> will be complied with; <br /> <br /> (iv) An earth barrier or comparable screening technique shall be constructed to <br /> effec~ the desire of the Ci'~y to adequately screen and buffer tee adjacent residential area <br /> from noise and visual impacts of the Terminal as required by federal, state and local <br /> regulations. The details of such barriers must be approved by the City of Portsmouth as <br /> part of the site development review process. Also, the barrier must be constructed as part <br /> of the earliest phase possible of construction to further mitigate the impacts of noise and <br />dust during construction. <br /> <br /> (v) Along the Elm Avenue frontage, screening and landscaping shall be provided to <br /> improve the appearance of this entrance into the City and the development site; <br /> <br /> (vi) The water supply system shall be of sufficient size to accommodate whatever <br /> supply of water is necessary to control dust emissions to the level of opacity stipulated <br /> by the Virginia Air Pollution Control Board for all phases of operation. <br /> <br /> (vii) Provisions shall be made tO use a crusting or binding agent or a controlled <br /> technique which will affect the same results on the coal storage piles which will keep the <br /> opacity level below the stipulated levels ih the Virginia Air pollution Control Board permit; <br /> <br /> (viii) There shall be installed, operated and maintained, an air quality monitoring <br /> system in the Cradock area to monitor the dispursion of coal dust from the rail lines and <br /> the terminal. The air quality shall meet the standards established by the Virgini& State <br /> Air Pollution Control Board~ <br /> <br /> (ix) All coal handling and operational facilities shall be designed to maximize dust <br />suppressions. The tunnel type coal reclaiming system is the only method of operation that <br />is acceptable at this time. If for some reason, it is found that this system is not feasible <br />because of the soil or water conditions of the site, an alternative system may be considered <br />by the Council of the City of Portsmouth. Any alternative system must be acceptable in <br />meeting all Virginia State Air Pollution Control permit requirements; <br /> <br /> (x) All site runoff from areas of rail car storage and dumping north of Paradise <br />Creek and the coal pile shall be collected in settlement/treatment ponds. Routine: sampling <br />and analysis shall be conducted in accordance with the NPDES permit from the Virginia State <br />Water Control Board to insure that the quality of water discharged from the site meets the <br />standards set in the permit; <br /> <br /> (xi) The coal storage pile shall have a base which conforms to the requirements of <br />the Virginia State Water Control Board, as stipulated in the permit; <br /> <br /> (xii) The owner shall install test wells on site and have them monitored to comply <br />with the Virginia State Water Control Board regulations for the protection of groung water; <br /> <br />(xiii) No vehicular access to the site shall be permitted on Victory Boulevard; <br /> <br /> (xiv) The movement and control of rail traffic through the City shall be in a manner <br /> acceptable to the City or its designated representative so as to minimize interference with <br /> vehicle traffic on City streets. High speed railroad system will be constructed to allow <br /> the unit trains to track into the facility at iS miles per hour. This system Will assure <br /> that the George Washington Highway intersection will be c!eared in approximately S minutes. <br /> If such system does not prove effective, the Council of the City of Port~mouth reserves the <br /> right to insist upon an alternate method for reducing peak period impacts which would include <br /> reducing the number of rail cars per train or prohibiting rail traffic from being operated <br /> in connection with the facility during peak vehicle travel which is Monday through Friday <br /> from 6:30 A.M. to 8:30 A.
