<br /> At a regular meeting of the City Council held on Tuesday, November 22, 1983, there were

<br />J. E. Johansen, Ben A. Beamer, Sr., J. Robert Gray, James W. Holney, III, Gloria O. Webb
<br />Absent: Jack P. Barnes
<br />
<br /> Rev.~Samuel L. Walker, Pastor of Trinity United Church of Christ, opened the meeting
<br />with prayer, followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Johansen welcomed all visitors in attendance.
<br />
<br /> Motion of Mr. Gray and seconded by Vice Mayor Beamer, minutes of the called meeting of
<br />November 2, 1983; minutes of the called meeting of November 8, 1983; minutes of the regular
<br />meeting of November 8, 1983; minutes of a special called meeting of November 10, 1983, ~to~'be
<br />ap~ro'ved as received, and was adopted by unanmmous vote.

<br />83-427 - Public Hearing on Group Housing Project:

<br /> On motion of Mr. Whitlow and seconded by Vice Mayor Beamer the application was approved
<br />by unanimous vote.

<br /> Mrs. Webb requested that Item 83-404 'and 83-393 (b) be removed from the consent agenda.

<br /> On motion of Mr. Gray and seconded by Mrs. Webb the following items approved on first
<br />reading at the regular meeting of November 8, 1983, were adopted and by the following vote:

<br /> WHEREAS, Francis J. Driscoll,
<br />for Portsmouth Terminal, Inc., has
<br />of the City of Portsmouth, Virginia,
<br />described; and
<br />
<br />Senior Engzneer, MMM Design Group, as consultant
<br />made application pursuant to ~40-69(b) of the Code
<br /> 1973, for the granting of a use permit as hereinafter
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to
<br />be done in connection with said application.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouta, Virginia:

<br /> 1. That the use for whic? the use permit hereinafter ~s sought:

<br /> (a) Will not adversely affect the health and safety of persons residing and
<br />working in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimenta] to the public use or injurious to the property or
<br />improvements in the neighborhood; and

<br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code
<br />
<br /> 2. That Portsmouth Coal Terminals, Inc. is hereby granted a use per~it pursuant
<br />to ~40~69~b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a coal
<br />storage facility on the property described in Exhibit A attached hereto.
