February 22, 2000 (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Girls, Inc. Center for Youth of Southwest Hampton Roads is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child daycare center on property located at 5905 Portsmouth Boulevard, and being more particularly described as: UP-99-16 Beginning at a point 650.70 feet east of the intersection of Portsmouth Boulevard and Hodges Manor Road along the southern right- of-way of Portsmouth Boulevard; thence 307.31 feet S77'38'00"E to a point; thence 354.19 feet S7'53'16"E to a point; thence 351.93 feet N 77'39'00"W to a point; thence 171.47 feet N6'21'00"E to a point; thence 65.18 feet N45'08'00W to a point; thence 126.85 feet N10'05'00"E to the point of beginning. 3. That this use permit is approved subject to the following conditions: (a) The occupancy of the childcare center shall be limited to no more than one hundred eighty-six (186) children. (b) The age range of the children shall be from three (3) to twelve (12) years of age. (c) Indoor hours of operation shall be limited to the hours between 6:30 a.m. to 6:00 p.m., Monday through Friday. (d) The outdoor play area shall be enclosed with a fence, at least four (4) feet in height. No more than one hundred twenty-five (125) children may occupy the play area at one time. (e) Outdoor play hours shall be limited to the hours between 8:00 a.m. and 6:00 p.m. (f) The applicant must maintain twenty-three (23) on-site parking spaces for staff and drop off/pick up of students. (g) The center shall comply with the submitted site plan (Exhibit A). (h) The center shall submit to all required inspections by the City's Fire Prevention Bureau, Public Health Department and Building Official. (i) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits. (j) All taxes and fees on the subject property and operation shall be paid when due. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council."
