February 22, 2000 <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Girls, Inc. Center for Youth of Southwest Hampton Roads is hereby <br />granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, <br />Virginia (1988) for the operation of a child daycare center on property located at 5905 <br />Portsmouth Boulevard, and being more particularly described as: <br /> <br />UP-99-16 <br /> <br /> Beginning at a point 650.70 feet east of <br />the intersection of Portsmouth Boulevard and <br />Hodges Manor Road along the southern right- <br />of-way of Portsmouth Boulevard; thence <br />307.31 feet S77'38'00"E to a point; thence <br />354.19 feet S7'53'16"E to a point; thence <br />351.93 feet N 77'39'00"W to a point; thence <br />171.47 feet N6'21'00"E to a point; thence <br />65.18 feet N45'08'00W to a point; thence <br />126.85 feet N10'05'00"E to the point of <br />beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) The occupancy of the childcare center shall be limited to no more than one <br />hundred eighty-six (186) children. <br /> <br /> (b) The age range of the children shall be from three (3) to twelve (12) years <br />of age. <br /> <br /> (c) Indoor hours of operation shall be limited to the hours between 6:30 a.m. to <br />6:00 p.m., Monday through Friday. <br /> <br /> (d) The outdoor play area shall be enclosed with a fence, at least four (4) feet in <br />height. No more than one hundred twenty-five (125) children may occupy the play area <br />at one time. <br /> <br /> (e) Outdoor play hours shall be limited to the hours between 8:00 a.m. and 6:00 <br />p.m. <br /> <br /> (f) The applicant must maintain twenty-three (23) on-site parking spaces for staff <br />and drop off/pick up of students. <br /> <br />(g) The center shall comply with the submitted site plan (Exhibit A). <br /> <br /> (h) The center shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official. <br /> <br /> (i) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br /> (j) All taxes and fees on the subject property and operation shall be paid <br />when due. <br /> <br /> REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br /> <br />
