<br /> At a Regular Meeting of the City Council on Tuesday, February 22, 2000,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts,
<br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager
<br />Ronald W. Massie, City Attorney G. Timothy Oksman.

<br /> Councilman Charles B. Whitehurst, Sr. opened the meeting with prayer, which
<br />was followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Mr. Pitts, and seconded by Mr. Moody, to approve the minutes of a Called
<br />Meeting on February 3, 2000, a Called Meeting on February 4, 2000, a Called Meeting
<br />on February 5, 2000, a Called Meeting on February 8, 2000, a Regular Meeting on
<br />February 8, 2000, and a Called Meeting on February 15, 2000, and was adopted by
<br />unanimous vote.

<br />- Public Hearing -
<br />
<br />00 43 Joint public hearing with the Portsmouth Redevelopment and Housing
<br />Authority to consider the approval of the redevelopment plan for the Tower
<br />Redevelopment Project.
<br />
<br /> Motion by Mr. Benn, and seconded by Mr. Pitts, to cancel the joint public hearing,
<br />and was adopted by unanimous vote.

<br />- Unfinished Business -
<br />
<br />Consent Aqenda
<br />
<br />99 - 252 - Use permit:
<br />
<br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to adopt the following
<br />resolutions, approved at the February 8, 2000 meeting, and was adopted by the
<br />following vote:

<br />99-252(b):
<br />
<br />"A RESOLUTION GRANTING A USE PERMIT TO GIRLS, INC. CENTER FOR
<br />YOUTH OF SOUTHWEST HAMPTON ROADS FOR THE OPERATION OF A CHILD
<br />DAY CARE FACILITY AT 5905 PORTSMOUTH BOULEVARD.
<br />
<br /> WHEREAS, the applicant, Girls, Inc. Center for Youth of Southwest Hampton
<br />Roads was granted a use permit on September 21, 1994, to operate a child day care
<br />facility for 142 children at 5905 Portsmouth Boulevard; and
<br />
<br /> WHEREAS, the applicant has now made application to amend said use permit to
<br />accommodate additional children at the facility; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of the
<br />application for an amended use permit with conditions.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
<br />
<br />1. That the use for which the permit hereinafter-described is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or
<br />working in the neighborhood of the proposed use;
