February 22, 2000 00-30(a): Use permit: "A RESOLUTION GRANTING A USE PERMIT TO THEODORE AND SANDRA PINNOCK FOR THE OPERATION OF A CHILD DAY CARE FACILITY ON LOT 3A SECTION 13 ON CAVALIER BOULEVARD. WHEREAS, the applicants, Theodore and Sandra Pinnock were granted a use permit on September 28, 1999, to operate a child day care facility for 150 children on Lot 3A, Section 13, on Cavalier Boulevard; and WHEREAS, the applicants have now made application to amend said use permit as a result of material changes in the facility's site plan; and WHEREAS, the applicants and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting the application for an amended use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Theodore and Sandra Pinnock are hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a child daycare center on property located on Lot 3A, Section 13 on Cavalier Boulevard, and being more particularly described as: UP-99-14 Beginning at a point 140'+ north of the intersection of Greenwood Drive and Cavalier Boulevard; thence, in a southerly direction 185.10'+ to a point; thence, in a westerly direction 150'+ to a point; thence, in a northerly direction 185.15'+ to a point; thence, in an easterly direction 152.58'+ to a point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) The occupancy of the daycare facility shall be limited to no more than one hundred fifty (150) children. (b) of age. The age range of the children shall be from newborn to twelve (12) years (c) Indoor hours of operation shall be limited to the hours between 6:00 a.m. to 6:00 p.m. Monday through Friday. Outdoor play hours shall be limited to the hours between 8:00 a.m. to 6:00 p.m.
