7?, <br /> <br />January 24~ 1984 <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH COMMUNITY SERVICES BOARD <br />TO OPERATE A GROUP RESIDENCE FOR ALCOHOL REHABILITATION AND TREATMENT FACILITY <br />AT 1000 GREEN STREET. <br /> <br /> WHEREAS, James M, Nixon, Executive Director for the Effingham Street Branch YMCA, has <br />made application pursuant to 240-79 (b) of the Code of the City of Portsmouth, Virginia, as <br />amended, for the granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit is sought: <br /> <br /> (a) Will not affect the health and safety of persons <br />neighborhood of the proposed use; <br /> <br />merits <br /> <br />residing or ~orking in the <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or improve <br />in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. The Portsmouth Community Services Board is hereby granted a use permit pursuant to <br />240-79 (b) of the Code of the City of Portsmouth, Virginia to operate a group residence for <br />thirty-two (32) residents for alcohol rehabilitation a~d. treatment at 1000 Green Street <br /> <br />of <br /> <br /> 5. The following conditions are prescribed for this use permit:. <br /> <br /> (a) Occupancy is limited to thirty-two residents unless Building and Fire Officials <br />the City of Portsmouth determine a smaller number is required. <br /> <br />(b) Ail fire, building and health codes must be met prior to occupancy. <br /> <br />(c) Off-street parking must be provided to accommodate the ~taff of the facility. <br /> <br /> (d) The use permit is granted to the Portsmouth Community Services Board and~or <br />their designee for an Alcohol Rehabilitation and Treatment Facility and is not transferrable <br />any other person, entity or.location. <br /> <br /> (e) This use permit shall expire on January 31, 1986, and any request for extension <br />of time must be supported by findings such as would be required if the use permit was being <br />required for the first time." <br /> <br />Ayes: Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br />- REPORTS FROM THE CITY MANAGER <br /> <br /> 84-27 Letter from the City Manager recommending adoption of an ordinance to amend <br />Chapter 35 of the City Code by adding Article XVI, Section 35-234, pertaining to Urban Enter- <br />prise Zone Exemption for Certain Real Estate. <br /> <br /> "As you are aware, Council is to approve certain provisions of the City's Urban Enterpris <br />Zone application which was recently approved by Governor Robb. <br /> <br /> The first ordinance(Section 35-234)would amend the appropriate section of the City Code <br />pertaining to exemption from taxation for improvements to rehabilitate residential, commercial <br />and industrial property. <br /> <br /> The section ordinance (Section 6-8.1) allows for the exemption of any buildigg, electrica <br />mechanical and plumbing ~ees in the Urban Enterprise Zone. <br /> <br /> It should be noted that the ordinance exempting taxation for improvements for rehabili- <br />tated residential, commercial and industrial property would be for structures 25 years of age <br />and older and the period of time for exemption from taxation would be ten (10) years. <br /> <br /> These matters have been approved in concept by you, however, the attached ordinance place <br />those concepts in law and establishes the effective date, January 1, 1984. <br /> <br /> I am also enclosing a brief paper which proviRes an overview of the purpose of the Enter- <br />prise Zone. <br /> <br />It is therefore recommended, and I concur, that you adopt the attached ordinances." <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, the following ordinance was adopted on <br />first and final reading, and by the followi,ng vote: <br /> <br /> <br />
