1. A detailed landscape plan shall be submitted to the Office Of Planning of the City of <br />Portsmouth for review and approval by the City Planning staff prior to the issuance of any <br />b~h~id.~ggpermit, such landscape plan to include: <br /> <br />and <br /> <br />(a) landscape buffer in southwestern corner betwoen existing homes and townhouses; <br /> <br /> (b) heavy landscaping along the Freeway right-of-way indicating plant material <br />appropriate as a noise barrier or a final site plan review provision of alternate barrier as <br />specified by the Department of Engineering & Technical Services. <br /> <br /> 2. The location of buildings in the southern and northern portion must be adjusted to <br />meet the setback requirements. <br /> <br /> 3. H. BOYETTE, JR. AND CO., INC. <br />TO CONSTRUCT A SEWAGE PUMPING STATION ON SITE TO SERVE THE WATERS~.EDGE <br />CONDOMINIUMS ON THE WEST SIDE OF POWHATAN AVENUE BETWEEN GRIFFIN AND <br />RACE STREETS. <br /> <br /> WHEREAS, P. H. Boyette, Jr.-and Co., Inc., has made application pursuant to [40-75 (b) <br />of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant ~a~d't~e Planning Director have done all things required to be done <br />' in connection with said application; and <br /> <br />WHEREAS, the PlanniNg Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or im- <br />provements in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. P. H. Boyette, Jr. and Co., Inc. is hereby granted a use permit pursuant to ~40-75(b) <br />~f the City Code to construct a sewage pumping station on site to serve the proposed Waters <br />Edge Condominiums on the west side of Powhatan Avenue between Griffin and Race Streets. <br /> <br />3. Rowe and'Richard P. Molenaar, has made application pursuant to ~40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting and <br />of a group housing project consisting of a ten (10) unit condominium structure at 454 Florida <br />Avenue; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith and has recommended approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of the housing project pursuant <br />to said §40-55 grants only an exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver or any other requirement embodied in the <br />Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any othe <br />applicable, local, state or federal law or regulation; and <br /> <br /> <br />
