January 24~ ]984 <br /> <br /> At a regular meeting of the City Council held on Tuesday, January 24, 1984, there were <br />present: <br /> <br />J. E. Johansen, Ben A. Beamer, Sr., J. Robert Gray, James W. Holley, III, <br />Gloria O. Webb, Morton V. Whitlow, George L. Hanbury, City Manager, Steven <br />Lieberman, City Attorney. <br /> <br />Absent: Jack P. Barnes <br /> <br /> Rev. Joseph L. Roberts, Pastor of Zion Baptist Church, opened the meeting With prayer, <br />followed by the Pledge of Allegiance to Flag. <br /> <br />Mayor Johan~en welcomed all visitors in attendance. <br /> <br /> Motion of Mr. Beamer and seconded by Mr. Gray, minutes of the special called meeting of . <br />January 5, 1984; minutes of the called meeting of January 10, 1984; minutes of the regular <br />meeting of January 10, 1984, to be approved as received, and was adopted by unanimous vote. <br /> <br /> 84-24 - Mayor Johansen present to Johannes tenBraak, former Chairman of Crime Line, Award <br />of Merit recognizing Gary D. Smith, Portsmouth Police Crime Line Coordinator, and Ira M. <br />Agricola, Executive Director, Portsmouth Council, Hampton Roads Chamer of Commerce, for their <br />outstanding dedication and commitment to the Crime Line. <br /> <br /> 84-25 - Mayor Johansen presented Certificates of Appreciation for services rendered to <br />the following former members of Boards/Commis'sions: <br /> <br />Ann Kennedy (Hedgepeth) Commission of Architectural Review <br />Margaret J. Bond - Library Board <br />Vincent Skeeter - Planning Commission <br />Roderick Triplett, III - Board of Examination of Plumbers <br />William E. Ellsworth - Board of Examination of Plumbers <br /> <br /> 84-26 -. J. Douglas Powell, Chairman of Group Housing/Condominium Study Committee, <br />presented a Status Report focused on four basic areas - why the study is necessary and urgent <br />to be brought up-todate on the major issues; fact finding phases employed which can be expand- <br />ed; and to identify three major objectives. (See Exhibit 84-26) <br /> <br />- UNFINISHED BUSINESS - <br /> <br />Consent Agenda <br /> <br />Vice Mayor Beamer request that Item 84-3(b) be removed from the consent agenda. <br /> <br /> On motion of Mrs. W~bb and seconded by Mr. Gray, the following items approved on first <br />reading at the regular meeting of January 10, 1984, were adopted and by the following vote: <br /> <br />84-3 - Rezoning, use permit, and group housing applications and amendments to the <br /> City Code: <br /> <br />(c) ,'ZONING AMENDMENT ORDINANCE Z 83-35" <br /> <br />. <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO <br />SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS <br />_AMENDED, SAID PROJECT BEING DESIGNATED AS GHP-83-8. <br /> <br /> WHEREAS, James V. Bickford has made application pursuant to §40-55 of the Code of the <br />City of Portsmouth, Virginia, 1973, as amended, for the granting and approval of a group <br />housing project consisting of forty-five (45) townhouse apartment units on a 3.5 acre site <br />south of Pepperwood Court north of the Western Freeway right-of-way and west of Towne Point <br />Road (Tax Plate 845, Parcel 4); and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have.met the <br />requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, ~s amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith, and has recommended approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of the group housing project pur2 <br />suant to said ~40-55 grants only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any requirement embodied in the <br />S~h~i§ion D~dinance, Zoning Ordinance, the Code of the City of Portsmouth, or any other <br />applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developers are aware that building permits or.other required permits will be <br />issued only upon compliance with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that <br />the certain group housing project designated as GHP-8.3-8 and more specifically shown on plans <br />prepared by C. Raeford Cure, Surveyor, P. C. , dated November 8, 1D83, and submitted with <br />correspondence from the Bickford Company dated December iS, 1983, such plans and document <br />having been filed with the appropriate officials of the City of Portsmouth, Virginia and made <br />part hereof is hereby grante~ approval subject to the following terms and conditions: <br /> <br /> <br />
