84-92 - Letter from the City Manager recommending adoption of a resolution appointing
<br />viewers for the.closure of a portion of Nottaway Avenue.

<br /> "On October 12, 1965, the Council of the City of Portsmouth closed a portion of Nottaway
<br />Avenue extending north from Brighton Street toward Dartmouth; however, the portion of Nottawa
<br />for a distance of appro×imately 108 feet south of Dartmouth was not closed. This portion of
<br />the street has never been improved as a public street and has been maintained by adjoining
<br />property owners.
<br />
<br /> As part~,~£ the City's on-going review of paper streets, the City Attorney has recommended
<br />and made application on behalf of the City the vacation, closure, and discontinuing of the
<br />remaining portion of Nottaway AVenue extending t08.5 feet south of Dartmouth Street. The
<br />atta~hed~?e~b~u~ti~n appoints viewers in accordance with the applicable State law to view the
<br />portion of such street, and to report to the Planning Commission, and ultimately the City
<br />Council, whether in their opinion any, and if any, what inconvenience would result in vacating
<br />and closing the paper street~ I, therefore, recommend the adoption of the attached resolution
<br />
<br /> On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution was adopted,
<br />and by the following vote:
<br />
<br /> "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSURE OF A PORTION OF NOTTAWAY AVENUE.
<br />
<br /> WHEREAS, the City of Portsmouth has made application to vacate, close and discontinue the
<br />hereinafter-described portion of Nottaway Avenue, and it appearing that notice of application
<br />and request for the appointment of viewers was duly advertised as required by law.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that A
<br />N. Kendrick, Charles R. Hudgins, Robert Reed, Harrison Miller and R. E. B. Stewart be appointe~
<br />viewers, and that Howard L~ Davis and Clinton J. Fortune be appointed alternate viewers in the
<br />event one of the preceding viewers fails to participate, said viewers to view the hereinafter-
<br />described portion of such street and to report to this Council in writing whether in their
<br />opinion any, and if any, what inconvenience would result in vacating and closing the following
<br />

<br />Crayton $110.58 for 1983 Personal Property Taxes without interest.

<br /> "The Commissioner of the Revenue is requesting a refund of 1983 Personal Property ~axes
<br />in the amount of $110.58 to Erma L. Cray~o~ 300 Wall Street, Portsmouth, VA.
<br />
<br /> Mrs. Crayton paid Personal Property taxes on a 1978 Chevrolet that was sold in February
<br />1982.
<br />
<br />I recommend that Council adopt this motion, and a refund p~ granted without interest."

<br /> Motion of Mr. Gray and seconded by Mrs. Webb, that authorization be granted,~as ~quested
<br />to refund to Erma L~ Crayton $110.58, without interest~ fD~ ~83~Re~$o~al?P~opa~y taxes, and
<br />was adopted by unanimous vote.

<br />K. Gilbert $23.20 for 1983 Personal Property taxes with interest.
<br />
<br /> "The Commissioner of the Revenue is requesting a refund of 1983 Personal Property taxe~
<br />in the amount of $23.20 to Gwendolyn K. Gilbert, 3502 Dartmouth Street, Portsmouth, VA.
<br />
<br /> Mrs. Gilbert was assessed on a 1981 Chevroletlinstead of a 1980 Chevrolet.
