<br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT
<br />TO ~40-88 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS
<br />AMENDED, SAID PROJECT BEING LOCATED AT 322 MARYLAND AVENUE.

<br /> WHEREAS, Duane O. Wilson and Thomas G. Midgette has made application pursuant to 640-55.
<br />the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting and approval
<br />Of a group housing project at 322 Maryland Avenue; and
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plan submitted
<br />therewith, and has recommended a conditional approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project t
<br />to ~40-SS grants only an exemption from certain requirements for residences as stated in said
<br />section and does not constitute a waiver of any other requirement embodied in the subdivision
<br />ordinance, zoning ordinance, the Code of the City of Portsmouth, Virginia, or any other appli-
<br />cable local, state or federal laws or regulations; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will b
<br />issued only upon compliance with the ordinances, laws or regulations applicable thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that
<br />certain group housing project being located at 322 Maryland Avenue and designated as GHP-84-2
<br />more specifically shown on plans prepared by C. Raeford Eure, dated January 4, 1984, and
<br />with the ,a~pprQpriate officials of the City of Portsmouth, Virginia on January 11, 1984 con~
<br />ing of a site plan and building elevation and floor plan, and which is made a part hereof, is
<br />hereby granted approval subject to the following terms and conditions:

<br /> (a) The parking spaces will be moved a minimum of six (6) feet towards the interior of ti
<br />lot so that sufficient backout area is provided into the alley."

<br />Other Items Under Unfinished Business:

<br /> 84-86 - Letter from the City Manager concerning an ordinance closing a portion of an
<br />unnamed alley on the west side of Rodman Avenue, deferred from the meeting of March 13, 1984.
<br />
<br /> "Attorney for Thomas C. Culpepper, Robert B. Quinn, Jr., John Parrish and Sol Soroko, whc
<br />own property on the west side of Rodman Avenue, have made application to close a portion of a
<br />10 foot alley across their property in order that the surrounding parcels can be combined to
<br />develop for commercial use. In accordance with the applicable State Law, City Council appoint
<br />ed viewers on January 10, 1984, and their report was forwarded to the Planning Commission for
<br />consideration. The Planning Commission at its regular monthly meeting on February 7, 1984,
<br />voted unanimously to recommend to Council that the alley be closed.
<br />
<br /> The viewers' report raised questions concerning the use of the alley for trgsh and garbag
<br />collection; however, the Director of Public Works has indicated that collections are not made
<br />in the alley because the alley ~ not wide enough for sanitation trucks to negotiate.
<br />
<br /> Prior to Council's March 13th meeting there was discussion regarding some outstanding
<br />concerns of adjacent property owners. Pat Coffield of m~t staff and Claudia Cotton of the
<br />Planning Department met with a Mr. Russell Britton (agent of Mfs.ltl W.~Hudgins and Manager
<br />of C. W. Hudgins Grocery), and Mr. Britton indicated his questions had been addressed.
<br />Mr. Britton stated he has worked cooperatively with Mr. Soroko in the past and would continue
<br />to do so.
<br />
<br /> A copy of the Planning Commission and viewers' report is attached for your consideration
<br />I recommend adoption of the attached ordinance closing a portion of an unnamed alley on the
<br />west side of Rodman Avenue."
<br />
<br /> On motion of Mr. Gray and seconed by Mrs. Webb, the following ordinance was adopted,
<br />and by the following vote:
<br />
<br />"AN ORDINANCE CLOSING A PORTION OF AN UNNAMED ALLEY ON THE WEST SIDE OF RODMAN
<br />AVENUE."
