March At a regular meeting of the City Council held on Tuesday, March 27, 1984, there were present: J. E. Johansen, Jack P. Barnes, Ben A. Holley, III, Gloria O. Webb, Mozton V. Steven Lieberman, City Attorney. Beamer, Sr., J. Robert Gray, James W. Whitlow, George L. Hanbury, City Manager, Bishop Thomas E. Talley of Twines Memorial Church opened the meeting with prayer, followed by the Pledge of Allegiance to the Flag. merit Mayor Johansen welcomed all visitors Class Of I. C. Norcom High School. in attendance, recognizing students of the Govern- Motion of Mr. Gray and seconded by Mr. Beamer, minutes of the called meeting of March 13. 1984; minutes of the regular meeting of March 13, 1984, to be approved as received, and was adopted by unanimous vote. 84-103 - Mayor Johansen presented a Certificate of Appreciation to William S. Moore, Jr. former member of the Jail Advisory Board, for services rendered. - UNFINISHED BUSINESS - Consent Agenda on-motion of ~r~Whi%low:ahd seconded b~iMr~. Webb~ the following items approved on first leading at the regular meeting of March 13, 1984, were adopted and by the following vote: ' [ i : 84~84 Rezoning~ fUSe permli ~d group housing project applications: (b) "ZONING AMENDMENT ORDINANCE Z 84-3" (c) "ZONING AMENDMENT ORDINANCE Z 84-4" (d) "A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH BAPTIST ASSOCIATION FOR THE EMILY GREEN HOME AT 410 AND S00 WESTMORELAND AVENUE. WHEREAS, the Portsmouth Baptist Association has made application pursuant to ~g0-76 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be don in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or im- provements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Portsmouth Baptist Assiciation is hereby granted Green Home as a group home for adults pursuant to ~40-76 described as follows: a use permit to operate the Emily (b) of the City Code at the property UP-84-3 BEGINNING at a point on the west right-of-way of Westmoreland Avenue 60' + north from its intersection with King Street; thence north along said right-of-way 320' +; thence west 175' + to the water line of Baines Creek; thence southerly along--said water line to ~he north right-of-way of King Street, a distance of 420' thence east along said right-of-way 195' +; thence north 60'; thence east 90' to the west right-of-way of Westmoreland Avenue, the point of beginning. 3. This use permit is approved subject to the following conditions: (a) The applicant shall comply with all codes, ordinances, policies and regulations of federal, state and local governments that may be applicable, and shall have obtained all necessary licenses and permits required for this use; (b) Use of the residence at 410 Westmoreland Avenue would be limited to a group hom~ for adults for a maximum of six (6) persons; (c) Use of the residential structure at SOO Westmoreland Avenue would be limited to group home for adults for a maximum of forty-seven (47) persons; and
