Webb~ the following items approved on <br />first leading at the regular meeting of March 13, 1984, were adopted and by the following <br />vote: ' [ i : <br /> <br />84~84 Rezoning~ fUSe permli ~d group housing project applications: <br /> <br />(b) "ZONING AMENDMENT ORDINANCE Z 84-3" <br /> <br />(c) "ZONING AMENDMENT ORDINANCE Z 84-4" <br /> <br />(d) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH BAPTIST ASSOCIATION <br />FOR THE EMILY GREEN HOME AT 410 AND S00 WESTMORELAND AVENUE. <br /> <br /> WHEREAS, the Portsmouth Baptist Association has made application pursuant to ~g0-76 (b) <br />of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as <br />hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be don <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or im- <br />provements in the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. Portsmouth Baptist Assiciation is hereby granted <br />Green Home as a group home for adults pursuant to ~40-76 <br />described as follows: <br /> <br /> a use permit to operate the Emily <br />(b) of the City Code at the property <br /> <br />UP-84-3 <br /> <br /> BEGINNING at a point on the west right-of-way of Westmoreland Avenue 60' + <br />north from its intersection with King Street; thence north along said right-of-way <br />320' +; thence west 175' + to the water line of Baines Creek; thence southerly <br />along--said water line to ~he north right-of-way of King Street, a distance of 420' <br />thence east along said right-of-way 195' +; thence north 60'; thence east 90' to <br />the west right-of-way of Westmoreland Avenue, the point of beginning. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br /> (a) The applicant shall comply with all codes, ordinances, policies and regulations <br />of federal, state and local governments that may be applicable, and shall have obtained all <br />necessary licenses and permits required for this use; <br /> <br /> (b) Use of the residence at 410 Westmoreland Avenue would be limited to a group hom~ <br />for adults for a maximum of six (6) persons; <br /> <br /> (c) Use of the residential structure at SOO Westmoreland Avenue would be limited to <br />group home for adults for a maximum of forty-seven (47) persons; and <br /> <br /> <br />
