122 <br /> <br />April 10, 1984 <br /> <br />Ayes: Barnes, Beamer, G~ay, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br />REPORTS FROM THE CITY MANAGER - <br /> <br /> 84-121 - Letter from the City Manager <br />the City Code Sections 38-2(b) and 35-3(c) <br />machinerF~dtool, and real estate taxes. <br /> <br />recommending adoption of an ordinance to amend <br />relating to penalty imposed on personal property, <br /> <br /> "The Commissioner of the Revenue, the City Treasurer and the Delinquent Tax <br />have indicated that the current penalty on personal property, machinery~and tool, <br />estate taxes appears to be inequitable. <br /> <br />Collector <br />and real <br /> <br /> Our present City Code states that a penalty of ten (10) percent of an unpaid tax, or $10 <br />whichever is greater is added to any taxes on personal property, machinery and tool, and real <br />estate, which have not yet been paid on or before the time these taxes are due and payable. <br />Frequently, a $10 penalty is applied to bills less than $10. A penalty of this size imposed <br />upon a relatively small bill is seen as being inequitable to the delinquent taxpayer. <br /> <br /> It is recommended by the Commissioner of the Revenue, the City Treasurer and the Delin- <br />quent Tax Collector, with the concurrence of the Director of Finance, that the City Code be <br />amended so the penalty imposed would be ten (10) percent of the unpaid taxes or ten ($10.00) <br />whichever is greater, but not to exceed the face amount of the bill. <br /> <br /> The City Attorney indicates the proposed change would not conflict with the State Law, <br />therefore, I concur and recommend your approval Of the attached ordinance." <br /> <br /> On motion of Mrs. Webb and seconded by Mr, Barnes, the fo~llowing ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTIONS 35-2(b) AND 38-3(c) PERTAINING TO PENALTY FOR NONPAYMENT <br />OF P~]~ ESTATE AND PERSONAL PROPERTY TAXES, RESPECTIVELY." <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb. Whitlow, Johansen <br />Nays: None <br /> <br /> 84-122 - Letter from the City Manager recommending adoption of an ordinance closing a <br />portion of Boulevard Street; amending resolution appointing viewers. <br /> <br /> "The City of Portsmouth made application to ~aeate, close, and discontinue an unnamed <br />street lying and extending from the east right-of-way line of Lee Avenue to the west right- <br />of-way line of Industrial Avenue and having a width of fifty feet (50'). The ."street" is <br />referred to on some street maps as "Boulevard Street". On October 25, 1983, viewers were <br />appointed by City Council and they have reported in writing that no inconvenience would resul~ <br />from the closing and discontinuing of the paper street. The Planning Commission unanimously <br />resolved to recommend to City Council the closure. <br /> <br /> It should be noted that the~City's interest in the street as well as the adjacent parcels <br />have recently been conveyed to the Industrial Development Authority who in turn will transfer <br />the property to Mr. Charles Willett for development purposes. <br /> <br /> I, therefore, recommend that the City C~cil adopt the ordinance closing a portion of <br />'~Boulevard Street[~.~'' <br /> <br /> One. motion of Mrs. Webb and seconded by Mr. Whitlow, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE CLOSING A PORTION OF BOULEVARD STREET: AMENDING RESOLUTION <br />APPOINTING VIEWERS." <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> 84-123 - Letter from the City Manager recommending adoption of a resolution authorizing <br />the conveyance of property to the Industrial Development Authority (Detroit Street at Lee <br />Avenue). <br /> <br /> "In,the late 1970's, the Council of the City of Portsmouth authorized purchase of parcels <br />of property in PlAners Point for eventual resale for commercial and industrial development. <br />The Director of Economic Development has received a proposal from Mr. Robert Foley to purchase <br />six (6) vacant lots totaling 75' x 200' owned by the City, The property is adjoining a half <br />acre parcel owned by Mr. Foley in the Pinners' Point section. Mr. Foley's parcel is improved <br />with a truck maintenance building with supporting offices, and employs 10 to 12 people. <br /> <br /> The proposed acquisition would allow for planned expansion of the present business and <br />additional parking. Also, this sale would allow the property to again become taxable and <br />enable us to retain an existing business. <br /> <br /> It is my recommendation that the City Council transfer this site to the Industrial Develo <br />merit Authority. The Authority would then sell this property to Mr. Foley for $12,000 ($35,000 <br />per acre). Finally, I would recommend that the transfer be subjec~ to the following conditioni <br />(1) standard site plan improvements, (2) ingress and egress approved by Traffic Engineer, and <br />(3) satisfactory screening from adjoining residential approved by City Planning." <br /> <br /> <br />
