April 10, 1984 Motion of Mr. Gray and seconded by Mrs. Webb, to adopt the resolution. Motion of Mrs. Webb and seconded by Mr. Whitlow, to amend the resolution to include the three (3)ite~r~c~zm~d~d~:~h~the City Manager, and was adopted by unanimous vote. On motion the following resolution was adopted, as amended, and by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY PROPERTY TO THE INDUSTRIAL DEVELOPMENT AUTHORITY (DETROIT STREET AT LEE AVENUE). WHEREAS, the City of Portsmouth owns certain real property located at the northeast intersection of Detroit Street and Lee Avenue, which property is no longer required for the use of the City and is, hereby, declared to be excess property; and WHEREAS, the Industrial Development Authority has made an offer to purchase said property for the purpose of combining the same with adjacent property for development of Industrial and Port related business; and WHEREAS, the Industrial Development Authority has agreed to pay the sum of Twelve Thousand Dollars ($12,000) for said property; and WHEREAS, ~2.09 (c) of the Charter of the City of Portsmouth provides that property may be conveyed to the Commonwealth of Virginia or a political subdivision thereof without advertisement--or receipt of bids; and WHEREAS, the Industrial Development Authority is a political subdivision of the Commonwealth of Virginia. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to convey the hereinafter-described property to the Industrial Development Authority of the City of Portsmouth for the sum of Twelve Thousand Dollars ($12,000). All that certain piece or parcel of land, situate, lying and being in the City. of ~ortsmouth, Virginia, bounded and described as follows: Beginning at the northeast intersection of Detroit Street and Lee Avenue; thence in an easterly direction along the northern boundary of Detroit Street 200' to the northwest intersection of Detroit Street and Industrial Avenue; thence north along the western boundary of Industrial Avenue 75' to a point; thence west and parallel with Detroit Street 200' to the eastern boundary Lee Avenue; thence south along the eastern boundary of Lee Avenue 75' to the Point of Beginning. BE IT FURTHER RESOLVED that the conveyance authorized therein shall require the Industria[ Development Authority to impose the following conditions on any~sUbsequent conveyance of the heretofore described property: 1. Standard site plan improvements; 2. Ingress and egress approved by Traffic Engineer; 3. Satisfactory screening from adjoining residential approved by City Planning. BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute such documents as maybe necessary to complete this transaction." Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen Nays: None 84-124 Letter from the City Manager recommending adoption of a resolution appointing viewers for the closing of a portion of Peninsula Avenue. "Timothy. A. Wood and Dorothy J. Wood have made an application to have a portion of Peninsula Avenue from the north right-of,way of Matthews Terrace north to the low water mark of Scotts Creek vacated and closed. As required by law ~he applicants have given the appro- priate notice of application. The attached resolution, if approved by City Council, appoints the necessary viewers and requests their recommendation. I recommend adoption of the resolution." On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution was adopted, and by the following vote: "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A PORTION OF.PENINSULA AVENUE. WHEREAS, Timothy A. Wood and Dorothy J. Wood have made application to vacate, close and discontinue the hereinafter-described portion of Peninsula Avenue, and it appearing that notice of application and request for the appointment of viewers was duly advertised as required by law.
