155 <br /> <br />22. 1984 <br /> <br />designated as GHP-84-6, and more specifically shown on plans and outline specifications pre- <br />pared by the office of Dan E. Griffin, Kenneth M. Sedlacko, and filed with the appropriate <br />officials of the City of Portsmouth, Virginia, and made a part hereof, is hereby granted <br />approval subject to the following terms and conditions as proffered by the developer by <br />letters dated March 26, 1984, April 3,1984 and May 3, 1984: <br /> <br /> (1) Construction will consist of seventy-three (73) single-family and/or duplex units <br />all designed in a traditional manner. <br /> <br /> (2) The development will be a condominium development in accordance with the rules and <br />regulations of the Virginia Real Estate Commission. The condominium rules and regulations <br />will incorporate the necessary rules and regulations to govern this particular development <br />as an adult community for persons fifty (50) years of age and older. Phase I of the proposed <br />development will consist of not less than twenty (20) units with the Balance of the property <br />designated as expandable condominium area. The development will establish a policy limiting <br />children to those in excess of age twelve (12). It is the intent of this proposed development <br />to provide a community with special security features and an environment for those persons <br />in the proposed special age group. <br /> <br /> (3) Minimum sales price for any unit within the development will be Sixty Two Thousand <br />($62,000) Dollars. <br /> <br /> (4) No more than seventy-three units will be constructed on the site and will consist <br />of twenty (20) duplex units and thirty-three (33) single-family detached units. <br /> <br /> (5) Eighty percent (80%) of the units constructed will have ga~g~s with automatic <br />door openers. <br /> <br /> (6) All major exterior walls (front, rear and side) will be brick veneer, and the total <br />exterior walls of the entire project will be at least eighty percent (80%) brick veneer. <br /> <br /> (7) All units will be a minimum of two (2) bedrooms with master bedrooms C~gu~lii!~fi on <br />the first floor and will be designed with central air conditioning and will contain either <br />thermal pane windows and/or storm windows. <br /> <br /> (8) Central security system will be provided in each unit constructed combining an <br />emergencyppDl~ and fire calling system with individual burglar alarms. <br /> <br /> (9) Within the development a paved walking path will be provided and benches will be <br />provided intermittently along the walking path for the convenience of residents. <br /> <br /> (10) All units will be constructed on crawl spaces and be designed so that the units <br />are adaptable for' handicapped accessibility. <br /> <br /> (11) Site lighting will be provided throughout the project along major streets and <br />walkways, and all residences will have yard lights. <br /> <br /> (12) Set backs along Twin Pines Road must be met after dedication of necessary right-of- <br />way for street improvements. <br /> <br /> (13) A detailed landscaping plan must be submitted to the Planning Office for Review <br />and approval prior to issuance of building permits." <br /> <br />(e) <br /> <br />'~ RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO <br />SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />AS AMENDED, SAID PROJECT BEING A 10 UNIT CONDOMINIUM STRUCTURE CALLED <br />VICTORIA SQUARE LOCATED AT 401-403 MARYLAND AVENUE AND DESIGNATED AS <br />GHP-84-3. <br /> <br /> WHEREAS, Alton F. Catlett, has made application pursuant to Section 40-55 of the Code <br />of the City of Portsmouth, Virginia, 1973, as amended, for the granting and approval of a <br />group housing project consisting of a ten (10) unit condominium structure at 401-403 Maryland <br />Avenue; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith, and has recommended approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of the group housing project <br />pursuant to said Section 40-55 grants only an exemption from certain requirements for <br />residences as stated in said section, and does not constitute a waiver of any requirement <br />embodied in the subdivision ordinance, zoning ordinance, the Code of the City of Portsmouth, <br />or any other applicable local, state or federal law or regulation; and <br /> <br /> ~HEREAS, the developer is aware that building permits or any other required permit <br />will be issued only upon compliance with the ordinances, laws or regulations applicable <br />thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the certain group housing project known as Victoria Square consisting of a ten (10) unit <br /> <br /> <br />
