<br /> (f) On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution approved
<br />on first reading at the Public Hearing held on June 12, 1984, was adopted on final reading,
<br />and by the following vote:

<br />"A RESOLUTIOn GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS ~¥iENDED, SAID
<br />PROJEST BEING A TEN UNIT APARTMENT BUILDING LOCATED AT 356 BROAD STREET AND DES-
<br />IGNATED AS GHP-84-8.

<br /> WHEREAS, Robert W. McCarty,
<br />the City of Por'tsmouth, Virginia,
<br />group housing project consisting
<br />and
<br />
<br />has made application pursuant to ~40-55 of the Code of
<br /> 1973, as amended, for the granting and approval of a
<br />of a ten (10) unit apartment building at 356 Broad Street;
<br />
<br /> WHEREAS, the application has been determzned by the Planning Commission to have met
<br />the requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973, as
<br />amended; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and has recommended approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of the housing project pursuant
<br />to ~0-55 grants only an exemption from certain requirements for residences as stated in
<br />said section and does not constitute a waiver of any other requirement embodied in the
<br />subdivision ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any
<br />other applicable local, state, or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or
<br />will be issued only upon compliance with the ordinances, laws,
<br />thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the certain group housing project consisting of a ten (10) unit apartmen~ building to
<br />be constructed at 356 Broad Street and designated as GHP-84-8 and more specifically described
<br />in correspondence from Kirk Berkeley, Architect, as shown on plans prepared by said architect,
<br />and filed with' the appropriate officials of the City of Portsmouth, Virginia, and made a
<br />part hereof, is hereby granted approval subject to the following terms and conditions:
<br />
<br /> (a) Design modifications stipulated by the Commission of Architectural Review be
<br />incorporated in the final plans.
<br />
<br /> (b] Standard site improvement plan be submitted to the Department of Engineering and
<br />include a picket fence enclosure around trash receptacles."
