<br />"A RESOLUTION GRANTING A USE PERMIT TO THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY
<br />(SPSA) TO CONSTRUCT AND OPERATE A SOLID WASTE TRANSFER STATION ON PROPERTY LOCATED
<br />NORTHEAST OF FREDERICK BOULEVARD AND SOUTHEAST OF INTERSTATE 264.
<br />
<br /> WHEREAS, the Southeastern Public Service Authority has made application
<br />§40-69 (b) of the Code of the City of Portsmouth, Virginia, as amended, for
<br />of a use permit as hereinafter-described; and
<br />
<br />oursuant to
<br />the granting
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be
<br />done in conneczion with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br />1. That the use for which the use permit is sought:
<br />
<br /> Ca)' Will not affect the health and safety of persons residing or working in the
<br />neighborhood of the proposed.use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or
<br />improvements in the neighborhood; and
<br />
<br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City
<br />
<br />Code.
<br />
<br /> 2. The Southeastern Public Service Authority (SPSA) is hereby granted a use permit
<br />pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, ~o operate a solid
<br />waste transfer facility at a site located north of Frederick Boulevard and southeast of
<br />Interstate 264 consisting of Tax Plate 165, Parcels 2, 3, and 4, and containing approximately
<br />6.35 acres of land bordered by the Interstate, Beltline Railroad, and Frederick Boulevard
<br />EUP- 84- 8) .

<br />3. The following conditions are prescribed for this use permit:
<br />
<br />Ca) No final disposal or storage of waste will be permitted.
<br />
<br /> ~) Dense evergreen screening be provided along north and east property
<br />provide a visual and noise buffer. The complete landscape plan must be submitted
<br />a site improvement plan to the Department of Engineering for review and approval.
