June 26. 1.984 <br /> <br /> 1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />working in the neighborhood of the proposed use; <br /> <br />persons <br /> <br />residing or <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />Code. <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City <br /> <br /> 2. Russ Rand Associates are hereby granted a use permit pursuant to 240-70 (bl of <br />the City Code to provide for incidental installation of products brought on premises at <br />the Twin B Auto Sales Store at 4714 Portsmouth Boulevard, which is located within a portion <br />of that parcel designated as Tax Map 435, Parcel 1. <br /> <br /> 3. This use permit is approved subject to the following conditions: <br /> <br /> (a) No more than forty percent (40%) of the structure may be used <br />installation. <br /> <br />for parts <br /> <br /> (bi Use is limited to parts installation and auto repair work is not permitted. <br /> <br /> (c) No storage of auto parts and cars will be permitteJ except within the enclosed <br />structure. <br /> <br />(d) All parts installation shall be accomplished within the structure. <br /> <br />prior to <br />provided <br /> <br />(~)- !Soti&~se~mcni~g~sli~llbe provided along.the northern property lines and installed <br />operation of the parts installation facility. Such screening must meet the criteria <br />for in §40-44 (a) of the City Code." <br /> <br />Ayes: Barnes, Beamer, Gray, Holley, Webb, Whitlow, Johansen <br />Nays: None <br /> <br /> (c) On motion of Mr. Beamer and seconded by Mrs. Webb, the following resolution <br />approved on first reading at the Public Hearing of June 12, 1984, was adopted on final <br />reading, and by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO GEORGE RICHARDSON TO OPERATE A GROUP <br />HOME FOR MENTALLY HANDICAPPED CHILDREN AT 3615 COUNTY STREET. <br /> <br /> WHEREAS, Edward B. and Jean D. Smith, by George Richardson, R. N., has made application <br />pursuant to ~40-78 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the <br />granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />1. That the use for which the use permit is sought: <br /> <br />City of Portsmouth, Virginia: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the City <br />Code. <br /> <br /> 2. George Richardson is hereby granted a use permit pursuant to ~40-78 (b) of the <br />City Code to operate a group home for mentally handicapped children at the property described <br />as follows: <br /> <br />UP-84-6 <br /> <br /> BEGINNING on the southside of County Street 90' east from its intersection <br />with Rodman Avenue; ~hence south:108.5'; thence east 75'; thence north 108.5' <br />to the south right-of-waY of County Street; thence west along said right-of-way <br />75' to the Point of Beginning. This property being designated as 3615 County <br />Stree% (Tax Plate 302, Parcel 84) and consisting of a structure with four (4) bed- <br />rooms situated on a 8,100 square foot lot. <br /> <br />3. This use.permit is approved subject to the following conditions: <br /> <br />time. <br /> <br />(a) No more than ten (10) children shall be cared for in the facility at any one <br /> <br /> <br />
