At the presen-t time, the City Code provides that
such change in status automatically terminates the exemption. The attached ordinance would
modify the City Code. to provide'for the pro~ation for.the current tax year.

We are not re&u~red ~o adopt.such proration; however, given the interest City Council
has in assisting senzors on limited or f~xed incomes, you may want to provide for this addi-
tional advantage to elderly and disabled property owners.

I recommend the adoption~of ~he attached ordi~an.ce.'

On motion of Mr. Gray and, seconded by Mrs. Webb, the following ordinance was adopted on
first and fia~l ~eading, an.d. by~tKe following vote:

"AN ORDINANCE TO AMEND THE CODE OF THE CITY 3F PORTSMOUTH, VIRGINIA, 1973,
BY AMEN. State Code Section 15.1~867 authorizes local governments to
abate and remove nuisances including weeds and debris and ~o charge and collect costs related
to that activity.

The present fee of ~35 was established in 1982 and was, at that time, considered'to be a
reasonable charge for adminstration of the program. Since that time, however, a more detailed
analysis of the activities associate~ with weed and debris removal indicates that personnel
salaries, fringe benefits, data mrocesszng costs and postal fees are far zn excess of $35', and
the current Administrative Fee is not adequate to cover local government expenditures for the
program. I prcpose that the fee be increased to an amount of ~75 which is a more realistic
charge in view of curre~ costs. ,

I recommend approval of the proposed amendments."

On motion of Mr. Beamer and seconded by Mr. Gray, the following ordinance was adopted on
first and final reading, and by the following vote:

'AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY
A34ENDING SECTIONS 39-6 AND 39-7 THEREOF, PERTAINING TO ABATEMENT OF WEED AND
DEBRIS NUISANCE."

Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, Holley
Nays.> ~one

84-246 - Letter from the City Manager recommelding denial of an ordinance to close a
portion of Peninsula Avenue from the north side of Bradford Terrace to Scott's Creek.

"Mrs. Dorothy Wood, abutting property owner, requests:closure of a portion of Peninsula
Avenue from the north side of Bmadford Terrace to Scott'S.
