July 24, 1984 <br /> <br /> WHEREAS, Ma~lyn W. Jennings, with the permission of Green Lakes Baptist Church, has <br />made application pursuant to 840-73 (b) of the Code of the City of Portsmouth, Virginia, 1973, <br />to transfer said use permit, and to expand the facility from twenty-five (25) children to lift <br />CS0) children; and <br /> <br /> ~gHEREAS, the applicant and the Planning Director have done all things required to be don~ <br />in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said use permit subject <br />to the conditions contained herein. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (za) ~Will not adversely affect the health and safety of persons residing or'working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; and <br /> <br />(c) Will be in accordance with the purposes of the Zoning Chapter of the City Code <br /> <br /> 2. Marilyn W. Jennings, Directress, Montesorri Children's Center, is hereby granted <br />a use permit pursuant to 840-73 (b) of the City Code to operate a preschool/kindergarten <br />facility in the Green Lakes Baptist Church, 1610 Hodges Ferry Road. <br /> <br />3. This use permit is approved subject to the following conditions: <br /> <br /> ~. (a) ,The preschool/kindergarten facilty classroom hours shall be limited to <br />9:00 a. m. to 2:00 p. m.. <br /> <br />(b) No more than thirty-five (35) children shall be in attendance at any one time. <br /> <br /> (c) Ail building, fire, and health codes must be met prior to occupancy and <br />prior to'commencement of operations of the facility. <br /> <br /> (d) This use permit is issued to Marilyn W. Jennings, Directress, Montessori Chil- <br />dren's Center, 1610 Hodges Ferry Road, and is not transferable to any other person, entity <br />,or~lQ~t~on.~.~.~~, <br /> <br /> (e) The applicant shall comply with all applicable codes, ordinances, policies, <br />and regulations of federal, state, and local governments, and shall obtain all necessary <br />license,s~ and permit. <br /> <br /> (f) If outdoor play is provided, a seven thousand (7,000) square foot fenced-in pla <br />area must be established on the property with site plan and type of fencing subject to approva <br />of the City Planning Staff prior to installation." <br /> <br />Ayes: Corprew, Gray, Lucas, Webb, Whitlow, Holley <br />Nays: None <br /> <br /> 84-210 - The following ordinance approved at fhe ~eetin~ of July 10, 1984, was taken up <br />and read: .~ . <br /> <br />"AN ORDINANCE TO APPROPRIATE $104,300 FROM THE CO>~IUNITY DEVELOPMENT FUND FOR <br />THE RENTAL REHABILITATION GRANT PROGRAM." <br /> <br /> Motion of Mr. Corprew to adopt on final reading, and motion died due to the lack of a <br />seconded. <br /> <br /> Motion of Mrs.~Webb and seconded by Mr. Whitlow, that Council to be briefed on %he matte~ <br />at a later date, and was adopted by unanimous vote. <br /> <br /> 84-226 - The following resolution deferred from the meeting of June 26, 1984, was taken <br />up and read: <br /> <br /> "A RESOLUT%ON ACCEPTING THE OFFER OF CHRISTOPHER A. KNOPP TO PURCHASE CITY OWNED <br /> PROPERTY (FORMERLY WINCHESTER DRIVE FIRE STATION PROPERTY)};~ AUTHORIZING THE CITY <br /> MANAGER TO CONVEY SAID PROPERTY UPON CERTAIN CONDITIONS." <br /> <br /> Motion of Mr. Gray and seconded by Mr. Whitlow, that the matter be tabled, and was <br />adopted by unanimous vote. <br /> <br /> REPORTS FROM THE CITY MANAGER <br /> Items <br /> 84-260 - The City Manager recommended that/84-264, Resolution appointing viewers to close <br />a portion of Partridge Street, and 84-265, Resolution appointing viewers to close a portion <br />of Halifax Avenue, be withdrawn.. <br /> <br /> Motion of Mrs. Webb and seconded by Mr. Gray, to concur in the recommendation, and Items <br />84-264 and 84-265, to be withdrawn, and was adopted by unanimous vote. <br /> <br /> <br />
