<br /> WHEREAS, the developer is aware that building permits or any other required permit will b
<br />issued only upon compliance with the ordinances, laws, or regulations applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project consisting of a 4 unit condominium to be constructed at 3019
<br />Bayview Boulevard and designated as GHP-84-13 and more specifically described in correspondenc
<br />from the Yates Group, Architects, dated July 16, 1984, and shown on plans filed with the appro
<br />priate officials of the City of Portsmouth, Virginia, such being made a part hereof, is hereb
<br />granted approval subject to the following terms and conditions:
<br />
<br /> (1) A detailed landscape plan must be submitted for review and approval to the Planning
<br />Office prior to the issuance of building permits;
<br />
<br /> (2) The applicant must install a privacy fence along the east side of the paved drive
<br />prior to the issuance of occupancy permits; and
<br />
<br /> (3) A site improvement plan must be submitted for approval to the Engineering and Tech-
<br />nical Services Department, such plan shall include proposed connection to sanitary sewers and
<br />water lines."

<br /> On motion of Mr. Beamer and seconded by Mrs. Webb, the following resolution was adopted,
<br />on final reading, and by the followinv vote:
<br />
<br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING
<br />A SIX UNIT APARTMENT BUILDING AT 105~115 CHARLES AVENUE AND DESIGNATED AS GHP-84-14.

<br /> WHEREAS, M. W. D. Associates, by Richard L. Dail, partner, has made application pursuant
<br />to ~40-55 of the Code of the .City of Portsmouth, Virginia, 1973, as amended, for the granting
<br />and approval of a group housing project consisting of a six unit apartment building at 105-11~
<br />Charles Avenue; and
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of 640-55 of the Code of the City of Portsmouth, Virginia, 1973; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application.and site plans submitted
<br />therewith and has recommended approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project pursuan
<br />to $40-55 grants only an exemption from certain requirements for residences as stated in said
<br />section and does not constitute a waiver of any other requirement embodied in the subdivision
<br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other applicable
<br />local, state or federal law or regulation; and
<br />
<br /> WHEREAS, the developer is aware that building permits or any other required permit will
<br />issued only upon compliance with the ordinances, laws, or regulations applicable thereto.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the certain group housing project consisting of a six unit apartment building at 105-115 Charl
<br />Avenue and designated as GHP-84-14, and more specifically described in correspondence from
<br />M.W.D. Associates, dated August 21, 1984, and plans filed with the appropriate officials of th
<br />City of Portsmouth, Virginia, such being made a part hereof, is hereby granted approval subjec
<br />to the following terms and conditions:
<br />
<br /> (!) Prior to issuance of any occupancy permits, the site improvement plan must be ap,
<br />proved by the Department of Engineering and Technical Services and the landscaping and privacy
<br />fence must be properly installed.
<br />
<br /> (2) A porch addition to the Charles Avenue facade must be designed and constructed and
<br />same must be reviewed and approved by the Planning Staff of the City of Portsmouth, Virginia,
<br />prior to construction."

<br /> 84-210 The following ordinance approved on first reading at the regular m~eai~g, of
<br />September 11, 1984, was taken up and read:

<br />!'AN ORDINANCE TO APPROPRIATE $104,300 FROM THE COMMUNITY DEVELOPMENT FUND FOR
<br />THE RENTAL REHABILITATION GRANT PROGRAM."

<br /> On motion of Mr. Beamer and seconded by Mrs. Lucas, the ordinance was adopted on final
<br />reading, and by the following vote:
