<br /> On motion of Mrs. Webb and seconded by Mr. Gray, the following resolution was adopted,
<br />and by the.~following vote:

<br />"A RESOLUTION GRANTING A USE PERMIT TO JOYCE HALL TO OPERATE A FAMILY CARE HOME
<br />AT 1229 ALCINDOR ROAD.
<br />
<br /> WHEREAS, Joyce Hall has made application pursuant to §40-75 (b) of the Code of the City o
<br />Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child care center
<br />and :
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things required to be done
<br />in connection with said application; and
<br />
<br /> WHEREAS; the Planning Commission has recommended the granting of a use permit for the
<br />operation of a family care home.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. That the use for which the use permit is recommended:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or working in
<br />the neighborhood of the proppsed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the
<br />provements in the neighborhood; and
<br />
<br />(c) Will be in accordance wi~h the purposes of the Zoning Chapter
<br />
<br /> 2. Joyce Hall is hereby granted a use permit pursuant

<br />children to be cared for at this facility at any one time.

<br /> (d) All health, fire, and building codes must be met prior to commencement of opera-
<br />tions of this facility.
<br />
<br /> (e) The applicant shall comply with all applicable codes, ordinances, policies, and
<br />regulations of federal, state, and local governments, and shall obtain all necessary licenses
<br />and permits; and
<br />
<br /> (f) This use permit is issued to Joyce Hall for 1229 Alcindor Road and is not transfe~
<br />table to any other person, entity, or location.

<br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION
<br /> 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING
<br /> A 4 UNIT CONDOMINIUM AT 3019 BAYVIEW BOULEVARD AND DESIGNATED AS GHP-84-13.

<br /> WHEREAS¥ Thomas A. Edwards has made application pursuant to Section 40-55 of the Code of
<br />the City of Portsmouth, Virginia, 1973, for the granting and approval of a group housing pro-
<br />ject consisting of a 4 unit condominium at 3019 Bayview Boulevard; and
<br />
<br /> WHEREAS, the application has been determined by the Planning Commission to have met the
<br />requirements of §40-55 of the Code of the City of Portsmouth, Virginia, 1973; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and has recommended approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project pursuant
<br />to §40-55 grants only an exemption from certain requirements for residences as stated in said
<br />section and does not constitute a waiver of any other requirement embodied in the subdivision
<br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other applicable
<br />local, state or federal law or regulation; and
