H. Boyette, Jr. & Company, <br />Inc., by P. H. Boyette, President, for six condominium units to be <br />added to existing units known as Waters Edge at the soutwest <br />corner of Race Street and Powhatan Avenue, approved on first <br />reading at the Public Hearing Of September 11, 19847 ~.k~ ~ <br /> <br /> 8~lD~to change building <br /> <br /> On motion of Mr. Whitlow and seconded by Mrs. Webb, the following resolution was adopted, <br />as amended, and by the following vote: <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br /> 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING <br /> AN ADDITION TO WATERS EDGE CONDOMINIUMS AND DESIGNATED AS GHP-84-10. <br /> <br /> WHEREAS, the Council of the City of Portsmouth granted approval for a group housing pro- <br />ject being known as Waters Edge and designated as GHP-83-6 on December 13, 1983; and <br /> <br /> WHEREAS P. H. Boyette, Jr. & Company, Inc. has made application pursuant to §40-58 of the <br />Code of the City of Portsmouth, Virginia, 1973, for the granting and approval of a group housii <br />permit consisting of an addition of six (6) more units to the Waters Edge Condominiums; and <br /> <br /> WHEREAS, the application has been determined by the Planning Commission to have met the <br />requirements of 940-55 of the Code of the City of Portsmouth, Virginia, 1973; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted <br />therewith and has recommended a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project pursuanl <br />to ~40-55 grants only an exemption from certain requirements for residences as stated in said <br />section and does not constitute a waiver of any other requirement embodied in the subdivision <br />ordinance, zoning ordinance, Code of the City of Portsmouth, Virginia, or any other applicable <br />local, state or federal laws or regulations; and <br /> <br /> WHEREAS, the developer is aware that building permits or any other required permit will b~ <br />issued only upon compliance with the ordinances, laws, or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the certaimqroup housing project known as an addition to Waters Edge Condominiums consisting <br />of six (6) units on the property adjacent to the southern boundary of the existing condominium <br />project now under construction and designated as GHP-84-10, more specifically shown on plans <br />submitted b~ ~e applicant and filed with the appropriate officials of the City of Portsmouth, <br />Virginia, as outlined in correspondence from P. H. Boyette, Jr. & Company, Inc. dated June 6, <br />1984, which plans are made a part hereof, is hereby granted approval subject to the following <br />terms and conditions: <br /> <br /> (t) A pamp~m~istation must be approved by the Department of Public Utilities and State <br />Health Department prior to issuance of occupancy permits; <br /> <br /> (2) Landscaping as shown on submitted plans must be Properly installed prior to issuance <br />of occupancy permits; <br /> <br /> (3) Standard site improvements plans must be submitted to the Department of Engineering <br />and Technical Services for approval." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Webb, Whitlow, H011ey <br />Nays: None <br /> <br /> 84-329 ~: The following ordinance approved on first reading at the regular meeting of <br />September 11~!1984, was taken up and read: <br /> <br />'AN ORDINANCE TO APPROPRIATE $30,000 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />REDESIGN OF CHURCHLAND PARK ANDT[IMPROVEMENTS AT CHURCHLAND HIGH SCHOOL ATHLETIC <br />FIELDS." <br /> <br /> On motion of Mrs. Webb and seconded by Mr Beamer, the ordinance was adopted on final <br />reading, and by the following vote: <br /> <br /> · -: AWes: Beamer, Corprew, Gray, <br /> Nays: None <br /> 7 <br />Other Items Under Unfinished Business <br /> <br />Lucas, Webb, <br /> <br />Whitlow, Holley <br /> <br />84-326 - Use permit and group housing project applications: <br /> <br />(e) U~e Permit <br /> <br />UP 84-9~;--~Use Permit application of C.
