<br /> SINGLE FAMILY DWELLING TO A DUPLEX AT 254 MARYLAND AVENUE.

<br />WHEREAS, David Green has made application pursuant to §49-102 (10) of the Code of
<br />the City of Portsmouth, Virginia, 1973, for the granting of a use permit as herein-
<br />after-described; and
<br />
<br />WHEREAS, the applicant and the Planning Director have done all things required
<br />to be done in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of said use permit.
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />i/That the use for which the use permit is sought:
<br />
<br /> (a) Will not adversely affect the health and safety of persons residing or workin
<br />in the neighborhood of the proposed use;
<br />
<br /> (b) Will not be detrimental to the public use or injurious to the property or
<br />i~yo¥~m~nts in the neighborhood; and
<br />
<br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the City
<br />Code.

<br />2. David Green is hereby granted a use permit pursuant to §40-102 (10) Of the City
<br />Code to convert an existing single family dwelling to a duplex at 254 Maryland
<br />Avenue, more specifically described as Tax Map 138, Parcel 14 (UP-84-11).

<br />3~. This use permit is approved subject to the following conditions:
<br />
<br /> (a) The applicant shall provide two (2) required on-site parking spaces as
<br />~ ~pg~.~yed by the Commission of Architectural Review for Port Norfolk and Park View.

<br />SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID
<br />PRO~ECT BEING DESIGNATED AS GHP-84-11.

<br />WHEREAS, MGB Associates, by Richard Griffith, Jr., partner, has made application
<br />pursuant to ~40-55 of the Code of the City of Portsmouth, 1973, for the granting and
<br />approval of a group housing project consisting of a four (4) unit apartment building
<br />to be developed at 2~50 Detroit Street, Portsmouth, Virginia; and
<br />
<br />WHEREAS, the application has been determined by the Planning Commission to have met
<br />the requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973;
<br />
<br />~HEREAS, the Planning Commission has reviewed such application and site plans sub-
<br />mitted therewith and has recommended approval of said application; and
<br />
<br />WHEREAS, the developer has been informed that approval of a group housing project
<br />p~rsuant to ~40~55 grants only an exemption from certain requirements for residences
<br />as stated in said section and does not constitute a waiver of any other requirement
<br />embodied in the subdivision ordinance, zoning ordinance, Code of the City of Ports-
<br />mouth, Virginia, or any other applicable local~ state or federal law or regulation;
<br />and
<br />
<br />WHEREAS, the developer is aware that building permits or
<br />will be issued only upon compliance with the ordinances,
<br />cable thereto.

<br />filed with the appropriate officials of the City of Portsmouth, Virginia, as describ-
<br />ed in correspondence prepared on behalf of the applicant by the Yates Group, Archi-
<br />tects, all of which are made a part hereof, is hereby granted approval."
