David Green is hereby granted a use permit pursuant to §40-102 (10) Of the City <br />Code to convert an existing single family dwelling to a duplex at 254 Maryland <br />Avenue, more specifically described as Tax Map 138, Parcel 14 (UP-84-11). <br /> <br />3~. This use permit is approved subject to the following conditions: <br /> <br /> (a) The applicant shall provide two (2) required on-site parking spaces as <br />~ ~pg~.~yed by the Commission of Architectural Review for Port Norfolk and Park View. <br /> <br /> (b) The applicant shall comply with all codes, ordinances, policies, and regula- <br />tions that may be applicable to the conversion and use as a duplex, and shall obtain <br />all necessary licenses and permits required for the conversion and subsequent use of <br />the property as a duplex." <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO <br />SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID <br />PRO~ECT BEING DESIGNATED AS GHP-84-11. <br /> <br />WHEREAS, MGB Associates, by Richard Griffith, Jr., partner, has made application <br />pursuant to ~40-55 of the Code of the City of Portsmouth, 1973, for the granting and <br />approval of a group housing project consisting of a four (4) unit apartment building <br />to be developed at 2~50 Detroit Street, Portsmouth, Virginia; and <br /> <br />WHEREAS, the application has been determined by the Planning Commission to have met <br />the requirements of ~40-55 of the Code of the City of Portsmouth, Virginia, 1973; <br /> <br />~HEREAS, the Planning Commission has reviewed such application and site plans sub- <br />mitted therewith and has recommended approval of said application; and <br /> <br />WHEREAS, the developer has been informed that approval of a group housing project <br />p~rsuant to ~40~55 grants only an exemption from certain requirements for residences <br />as stated in said section and does not constitute a waiver of any other requirement <br />embodied in the subdivision ordinance, zoning ordinance, Code of the City of Ports- <br />mouth, Virginia, or any other applicable local~ state or federal law or regulation; <br />and <br /> <br />WHEREAS, the developer is aware that building permits or <br />will be issued only upon compliance with the ordinances, <br />cable thereto. <br /> <br />any other required permit <br />laws, or regulations appli- <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the certain group housing project consisting of a four (4) unit apartment build! <br />at 2550 D~troit Street and designated as GHP-84-11, as shown on plans prepared and <br />filed with the appropriate officials of the City of Portsmouth, Virginia, as describ- <br />ed in correspondence prepared on behalf of the applicant by the Yates Group, Archi- <br />tects, all of which are made a part hereof, is hereby granted approval." <br /> <br />Ayes: <br />Nays: <br /> <br />Beamer, Corprew, Gray, Lucas, Webb, ~ghitlow, Holley <br />None <br /> <br /> <br />
