244 <br /> <br />September 25~ 1984 <br /> <br />Consent Agenda <br /> <br /> Councilman Gray <br />Consent Agenda. <br /> <br />UNFINISHED BUSINESS - <br /> <br />requested that Item 84-326(h) and Item 84-329 be removed from the <br /> <br /> On motion of Mrs. Webb and seconded by Mr. Beamer, the following items approved on first <br />reading at the regular meeting of September 11, 1984, were adopted and by the following vote: <br /> <br />84-326 ~ Rezoning, use permit and group housing project applications: <br /> <br />(a) ',ZONING AMENDMENT ORDINANCE Z 84-12" <br /> <br />lc) "A RESOLUTION GRANTING A USE PERMIT TO ROY C. FIELDS AND HENRY S. STATON <br /> TO OPERATE AN AUTOMOTIVE SERVICE STATION AT 2612 ELLIOTT AVENUE. <br /> <br />W~REAS, Roy C. Fields and Henry S. Staton have made application pursuant to 940-70 <br />(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a <br />use permit as hereinafter-described; and <br /> <br />WHEREAS~ the applicant and the Planning Director have done all things required <br />to be done in connection with said application; and <br /> <br />~WHEREAS~i the Planning Commission has made a recommendation regarding the granting <br />of Said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or work- <br />i~ in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements of the neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes of the Zoning Chapter of the City <br />Code. <br /> <br />2. Roy C. Fields and Henry S. Staton are hereby granted a use permit pursuant to <br />§40-70 (b) of the Code.of the City of Portsmouth, Virginia, 1973, to operate an <br />automotive service station as defined in ~40-31 at 2612 Elliott Avenue, such pro- <br />p~.ty being further described as Tax Map 414, Parcel 10 (UP-84-12). <br /> <br />3. This use permit is approved subject to the following condition: <br /> <br /> (a) A six (6) foot privacy fence be erected along the rear property line prior t( <br />operation as an automotive service station." <br /> <br />(f) '~'A RESOLUTION GRANTING A USE PERMIT TO JAMES K. BYNUM TO CONVERT AN EXISTING <br /> SINGLE FAMILY DWELLING TO A DUPLEX AT 64 LINDEN AVENUE. <br /> <br />WHEREAS, James K. Bynum has made application pursuant to ~40-102 (10) of the Code <br />of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as <br />hereinafter described; and <br /> <br />WHEREAS, the applicant and the Planning Director have <br />to be done in connection with said application; and <br /> <br />done all things required <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. This use permit is approved subject to the following conditions: <br /> <br /> (a) The applicant shall provide the two (2) required on-site parking spaces as <br />approved by the Commission of Architectural Review for Port Norfolk and Park View. <br /> <br /> <br />
