Beamer and seconded by Mrs. Webb, the followxng items approved on first reading at the regular meeting of Sgpt. em~b~r ~, i984, were adopted by the following vote: 84-354 Rezoning, use permit and amendments to the City Code: (a} "ZONING ~MENDMENT ORDINANCE- Z 84-8-PDrtSon,B" (b) "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTIONS 40-121(a)(i), (ii), (iv), Iv), (vi), 40-121(b), 40-122, 40-123, AND 40-31, AND BY REPEALING SECTIONS 40-121(a), (iii) AND (vi), PERTAINING TO THE DOWNTOWN D-I DISTRICT." (e) "A RESOLUTION GRANTING A USE PERMIT TO W. W. REASOR TO CONSTRUC~ A SEWAGE PUMPING STATION TO SERVICE PHASE I OF THE PROPOSED LONGPOINT DEVELOPMENT. WHEREAS~ W. W. Reasor, by C. Raeford Eure, has made application pursuant to $40-74 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or im- provements in the neighborhood; and - (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. W.W. Reasor is hereby granted a use permit pursuant to ~40-74 (b) of the City Code to construct a sewage pumping station to serve Phase I of the proposed Longpoint development.
