Robert Gray, <br />L. Louise Lucas, Gloria O. Webb, Morton V. Whitlow, George L. Hanbury, City Manager, <br />Steven Lieberman, City Attorney. <br /> <br /> Rev. Robert N. Huffman, Rector of Trinity Episcopal Church, opened the meeting with <br />prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br /> Motion of Mr. Gray and seconded by Mrs. Webb, minutes of the special called meeting of <br />October 3, 19841 minutes of the called meeting of October 9, 1984; and minutes of the regular <br />meeting of October 9, 1984, to be approved as received, and was adopted by unanimous vote. <br /> <br />Mayor Holley welcomed all visitors in attendance. <br /> <br /> Mayor Holley recognized Scout Master Richard Corvello, Assistant Scout Masters Jim Terrel <br />and Captain Arthur Shaw, and members of Boys Scout Troop 219, attending the meeting on working <br />toward their Merit Badge on Citizenship in the Community. <br /> <br /> 84-392 Mayor Holley presented Certificates of Appreciation to Raymond Joseph, former <br />member of IDA/PPIC; Dan E. Griffin, former member of Board of Appeals, and Eugene W. McNeal, <br />former member of Portsmouth Housing Development Board, for their services rendered. <br /> <br />- UNFINISHED BUSINESS <br /> <br />Consent Agenda <br /> <br /> On motion of Mr. Gray and seconded by Mr. Beamer, the following items a~proved on first <br />reading at the regular meeting of October 9, 1984, were adopted on final reading by the fol- <br />lowing vote: <br /> <br />84-375 Rezoning, use permit and amendments to the City Code: <br /> <br />Ca) "ZONING AMENDMENT ORDINANCE Z 84-8- Portion C" <br /> <br />(b) "AN ORDINANCE TO _~MEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br /> AMENDING SECTION 40-121(a) (ii), PERTAINING TO THE DOWNTOWN D-1 DISTRICT." <br /> <br />(c) "ZONING AMENDMENT ORDINANCE Z 84-16" <br /> <br />(f) <br /> <br />"A RESOLUTION AMENDING THE USE PERMIT GRANTED TO MR. AND MRS. THOMAS B. <br />VELASCO TO OPERATE A PRIVATE RESIDENCE AND HOME FOR THE ELDERLY AT 3736 <br />TURNPIKE ROAD. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, granted a use permit to Mr. ant <br />Mrs. Thomas B. Velasco to operate a private residence and home for the elderly near the inter- <br />section of Utah Street and Kigman Avenue on January 8, 1980, which permitted no more than nine <br />(91 elderly female guests mn the convalescent and nursing home; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, amended said use permit on <br />October 25, 1983 to permit residency by not more than twelve (12) elderly persons; and <br /> <br /> WHEREAS, Mr. g Mrs. Velasco has made application pursuant to ~40-~5 (bl of <br />the City of Portsmouth, Virginia, 1973, to amend said use permit to add twenty <br />elderly persons; and <br /> <br />the Code of <br />20) additional <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be done <br />in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESCLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing and working <br />in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurmous to property and improve- <br />ments in the neighborhood; and <br /> <br />(c) Will be in acccrd with the purposes of the Zoning Chapter of the City Code. <br /> <br /> 2. That Mr. & Mrs. Thomas B. Velasco is hereby granted a use permit pursuant to ~49-75 <br />~b) of the Code of the City of Portsmouth, Virginia, 1973, to operate a private residence and <br />home for the elderly on property hereinafter-described: <br /> <br />UP-84-14 <br /> <br /> Beginning at the northeast corner of Utah Street and Turnpike Road; thence <br />northerly along Utah Street 175'; thence easterly 200'; thence southerly 175' <br />to Turnpike Road; thence westerly 200' to Utah Street; the point of origin. Such <br />property being more specifically described as 3736 Turnpike Road, T~x Plate 329, <br />Parcel ~8. <br /> <br /> <br />
