Hill, and Barbara Lee, are hereby granted a use permit <br />pursuant to ~40~78 (b) of the City Code to operate a child care center at 1500 Summitt Avenue. <br />such property being more particularly described as follows: <br /> <br />HP-84-16 <br /> <br />of <br /> <br /> BEGINNING at the northwest corner of Beech Street and Summitt Avenue; thence <br />west along the northern right-of-way of Summitt Avenue 75'; thence north 108'; <br />thence east 75' to the west right-of-way of Beech Street; thence south along said <br />right-of-way 108' to Summitt Avenue, the Point of Origin. <br /> <br />3. Hill, and Barbara Lee for <br />Summitt Avenue and is not transferable to any other person, entity, or location." <br /> <br />Ayes: Beamer, Corprew, Gray, Lucas, Whitlow, Holley <br />Nays: Webb <br /> <br />Other Item Under Unfinished Business <br /> <br />84-412 Rezoning Application: <br /> <br />(a) Z-84-11 <br /> <br />THe City Manager <br /> <br />- Rezoning application of Ralph & Debbie Nahra by Hugh W. Johnston, <br /> Agent for American Fidelity Insurance Agency, Inc., to rezone a <br /> parcel of land on the west side of George Washington Highway and <br /> north of the Portsmouth City limits, deferred from the Public Hearing <br /> of November 13, 1984. <br />submitted the following letter: <br /> <br /> "During the November 13 Public Hearing on a rezoning request for property located on <br />George Washington Highway, questions were raised regarding applicable fire safety codes as <br />well as appropriate land use from an economic development standpoint. <br /> <br /> As you will recall, the property for which rezoning was requested abuts the ~a~cel o~cur <br />pied by Suburban Propane. That area was annexed by the City of Portsmouth in 1960. Since <br />that time Suburban Propane has consistently met fire code requirements and has been most co- <br />operative with the Fire Department with regard to safety guidelines. Additionally, Suburban <br />Propane is the source of approximately $10,400 in annual City revenues in the form of real <br />estate, business personal property and license taxes. <br /> <br /> Although Suburban Propane has maintained an excellent record of f%re safety, several L.P. <br />gas storage tanks are located at its George Washington Highway site. For this reason, Chief <br />Odell Benton recommends against allowing the construction of group housing adjacent to that <br />property. <br /> <br /> It is possible that residential development of the parcel might produce a higher per <br />acre valUe than a light industrial use for which the property is presently zoned. However, <br />due to the size and location of the parcel, it may be marketable for light industry, although <br />marketability for that purpose may be difficult." <br /> <br /> On motion of Mr. Corprew and seconded by Mr. Whitlow, Z 84-11 to rezone a parcel of <br />land on the west side of George Washington Highway and north of the Portsmouth City limits, <br />the following ordinance was approved on first reading by unanimous vote: <br /> <br />"ZONING AMENDMENT ORDINANCE Z 84-11" <br /> <br /> <br />
